Damaged P45 for NLV

Hi all , I wonder if anyone could help with my NLV application . We are advised that both myself as the main applicant will need to show a P45 at the Edinburgh Spanish Consulate and also my wife will need to show her P45 , does anyone know  if this is correct ? The problem being my wife retired in 2020 and damaged her P45 and we are finding it impossible to replace it from her ex employer and HMRC ! Any advise would be greatly accepted

I've never heard of anyone having to produce a P45....

Just out of interest are you applying for the NLV under retirement age?

How damaged is the document? Would you know all details provided and information on the document? If so I am on the understanding you can download a HMRC P45 PAYE draft form on search 

www.gov.uk

You can then download and print a blank P45 form and fill in all details known to you and hopefully when completed attach to the original.

If you’re wife is receiving a private pension from her last employer, the pension provider may have a copy of a P45 in your wife’s work history.

HMRC do not provide replacement copies.

Hi Steve  

My wife and I are 59 and 60 and I've been told by a couple who applied successfully last year in Edinburgh that they needed a P45 . Unfortunately we lost touch with them and don't know if they both needed to show a P45 ?

It appears to be only Edinburgh asking for P45's but it should not be necessary as income has to shown as coming from passive sources such as savings, pensions, dividends, etc.

In some cases NLV applicants will want to continue working and only quit their jobs, and therefore get a P45, once their visa application has been successful so for them demanding it upfront places them in an impossible catch 22.

The NLV does not allow the applicant to earn an income. So maybe they have to provide the P45 to show they have quit their job. I'd have thought that it would need to be a fairly recent P45.

Hi Peter , the document isn't that badly damaged fortunately and you can read all the information.  That's a great idea of downloading a blank P45 form and filling in the information. My wife wasn't employed long enough to enroll in a pension fund unfortunately .

Hi all , we have now found the template for a blank P45 and can fill in the information ourselves. We are going to forward it to the Edinburgh Consulate and ask if this and the original together will be ok.

When we submitted our Application for a NLV at the London Embassy last year we received a letter requesting a P45 for both my wife and I.  We had 10 days from the postmark of the letter to get the documents to the Embassy!!

I went onto the HMRC site and DWP site and traced my wife's work history as she had not worked since 2010.  Downloaded the information as proof of last day of working, wrote a cover letter explaining the situation attached the downloaded information.  It was the site for (NI Contributions)

I managed to find one from a private pension I closed in 2018, submitted that.

I have had contact with others that had the same issue and one application was refused as they were still working at the time of the Application, they were proposing to stop working if their VISA was approved scenario.

I think that this is a key bit of information for anyone applying for their NLV. They mustn't still be earning an income from employment at the time that they make their application. They must have already retired.

I would imagine that a few people would have hoped to hedge their bets and continue working until they were sure that they were getting their visa. Clearly, that approach won't work.

As for the OP, as the bank statements supplied with the application won't show any income from employment coming in then I can't imagine that it will be a problem.
