We are looking to come over to buy a holiday home once the pandemic is over. Our preffered area would be either La Zenia or Cabo Roig, I have read elsewhere that after Brexit we British now have to do a criminality check if the property is a certain distance from any military sites. Does anyone know what checks or proof would be required from the UK to satisfy Spanish regulations ? I have recently had a Disclosure Scotland check when starting a new job and wondered if this would be sufficient or would we need something signed by a British solicitor ?

I would be surprised if they would accept the info which you have already and would expect that the checks will have to be carried out by a Spanish Lawyer, but i may be wrong. I've also heard that it isn't a quick process. There is a company called Spanish Solutions based in La Zenia who seem very helpful and you may find that they will give free initial advise (please satisfy yourself that this is the case for your enquiry)  on the expectation that you will give them the business. Ive used them before and found them very good

4.   What is involved in making an application for military permission to buy in Spain? The process isn’t as scary as it initially sounds. There is no military interrogation using a chair and a spotlight! In fact there is no interrogation or interview at all. Quite simply an application is presented to the Military along with a copy of your passport and your criminal record and then the military will do their background checks on you using that information. In due course the Military Permission decision is issued. That permission is then presented to the Notary when you sign your Title Deed (Escritura) for the purchase. 

5.   How do I obtain my criminal record? You can get a Police Certificate which sets out whether you have a criminal record or not. Details of how to obtain this can be seen on the ACRO website - https://www.acro.police.uk/police_certificates.aspx  

6.   How long does this take to get military permission in Spain? This will depend on how busy they are, how many applications they have to deal with and how complex your application is. Sometimes it can take 2- 4months but typically it can take up to 6 months.

Thanks for the replies folks I have actually spoken to my Spanish solicitor and sent him a copy a  Disclosure Scotland form which he said would be sufficient if I sent it in PDF for translation also said it would take 2-3 months to process. So looks like it's not so bad as I thought only problem now is getting to Spain
