Power of Attorney

When we bought our home here in Spain about 4 years ago we gave our Spanish Lawyer full Power Of Attorney. Should we now be removing this P.O.A from our Lawyer?? We did this so that they could set up all our Utility bills etc with our bank. We are Non Residents. We  have now set up our own Bank and moved all our own utils bills to our new bank without using our Lawyer so i really dont think that we need to give them P.O.A?

If we should remove this what is the process for doing this yourself please?

You should revoce the POA conveniently (but not necessarily) before the same notary public who set up the POA instructing him to advise the authorized respresentative about said revocation.

Interestingly, Covid/travel restrictions have served to highlight the disadvantages of NOT having POA in place ... issues with elapsing bank accounts, utilities, etc.

FWIW, we are Spanish residents, and we have re-implemented POA.

Hi too late now , we revoked this morning as we can't see a really good reason to keep this in place. But thank you for your advise

Hi

I have a house in Torrevieja for 20 years now. Like you I gave P.O.A. to the solicitors at the beginning.  We have spent the last 3 winters there now. Since living there I really see what it's like.  I've been cheated by builders, robbed by so called agents, robbed by builders.  The place is full of crooks, cheats, liars,  and failures who can't make it in their own country.  You just go to your solicitor and tell them you want to close your account and withdraw the P.O.A.  my solicitors were charging about 400 for my non residencia tax including their fee of 130.  I went to a gandor ( something like that ) and they did it for 120 tax and 50 fee.  Solicitors will try to rob you also..   You don't need them nowTake back that POA and close your account.  I'm very nervous and disappointed.  I went to Guardia Civil and filled in forms about the builder who took my money but heard no more.  You are on your own down there . Be careful.  I'm in Dublin now but will be going down soon for the winter.

Well done. Gestor is the word I was looking  for.  Brexit is flushing out a lot of those chancers.
