90/180 day rules

Morning all, aware that there have been some previous script on this issue but having just completed my allowed 90 days in the previous 180, I would like to know if anyone’s done the same and then upon return to the Uk applied for a long stay visa to then return to Spain longer that the 90 day rule. I have the required NIE number and pay all my Taxes having purchased a property 2 years ago. I have a Spainish car and pay car tax and insurance in Spain with a Spanish company. I don’t want to work in Spain I just want to visit my property for longer each year.  Those that feel compelled to gloat about BREXIT and to tell me what I can not do, I would respectfully ask that you don’t reply has I would like to know from like minded people like me whom have a genuine request for help and information.

Hi,

What do you consider to be a "Long Stay" visa?

There are no long stay visas available. If you are thinking of the non lucrative visa, that gives you access to Spain but requires that you apply for residency within the first month otherwise you still only have the 90 day allowance.

Many thanks for your quick and helpful reply. I not looking for residency at this stage it’s maybe 2 years to early. I was more looking to be able to stay longer than the 90/180 rule. Maybe 150 days or less. I’m also aware that before COVID the Spanish were looking into the staying longer issue if you had NIE and owned a property like myself and to my knowledge it was put on hold. I did no know if any readers had any update on if this was being looked into again now that we have turned the corner on COVID ?

Hi David,

Sorry to say that those issues are still on hold and no agreement has been made yet. Until then I'm afraid that the 90/180 still holds.

There has been nothing official regarding the proposed variation in the 90 days/ 180 days rule which was being considered by Spain. But I believe it is still on the table!. But the fact that if Spain adopted this amendment it would mean they have moved from the existing EEC rules will likely make it difficult. They do have the right to go it alone if they choose to do so. So let’s see, there are quite a lot of disagreements right now within the EEC its self with regard to various issues, so all you can do is wait, it’s not inconceivable it could happen.

Many thanks for your perspective on this issue. I’m hoping too that sometime soon the Spanish gov revise their view on stay durations. If we pay all our taxes and live in a respectful way whilst spending hard earned money then this should be enough for Spain to allow us more access to our properties that we own and also paid high taxation on buy.
