New Non Lucrative Visa Process?

Hi all, I've just heard that the Non Lucrativ,e Visa can now be applied for whilst in Spain, negating the need to visit the Spanish Consulate in the UK.

Further to this, I have also heard that there is no longer a 5 year process (ie; reapply after year 1 and year 3, until 5 years completed), to then gain Residencia.

Does anyone know if this is fact, or fiction?

Hello

I think you'll find its all fiction, nothing has changed. I havent seen/read anything & it hasn't been posted anywhere on this forum.

 You have to start the process in UK at Spanish embassy to apply for your Visa to  see if you meet the criteria to even be able to  live here, they wouldnt let you come here first, that would defeat the object.

This process has been in place for years for 3rd country nationals, which is what the UK citizens are now after Brexit ( No more freedom of movement)

Where did you "hear" this information?

A friend has just returned to her property in Spain and been given this info by her Lawyer. Im sceptical, because ive not heard anything from any other source. See document below - cheers!

Hi Paul,

The Non Lucrative Visa application is made in two parts: the VISA (in the UK) and the PERMIT (in Spain).  The document you've attached isn't specific, but appears to describe the requirements for a Permit application.  Until the Spanish government website says that this has changed, I'm sceptical.  If I were your neighbour, I'd be asking the lawyer for a link to the Spanish government website that reflects this change of procedure - I've checked and there appears to be no change:

Yes, im really not sure on this. She did say by doing it this way, your proof of cash/income must be in a Spanish bank account, so maybe some kind of way for the Spanish Government to tax you on that money, whether or not it is income or savings. That's the only reason I can think of, for them to (allegedly) change or adjust the process.

Hi Paul, 

When you become resident in Spain, you're liable to declare your worldwide assets here and all income derived from them is taxed here in Spain (with a couple of exceptions, such as "Crown" pensions).  The UK and Spain have a bilateral "Dual Taxation Agreement", which is unaffected by Brexit, so Spain has no need to do anthing beyond what they already require of immigrants to declare their taxes here - the fines for failing to do so are punitive.

I don't know why your neighbour has assumed that the note from her lawyer negates the requirement for a visa application in the UK, but given that this is not reflected on the Spanish government's website, I would be asking the lawyer that specific question.
