Hi All

I obtained my Resedencia at the beginning of Nov. I needed to come back to the UK to arrange the sale of my home.
My Gestor said it would be fine as it could take up to 10 weeks to get my fingerprint appointment. 

My appt came on 19th Jan I was unable to get out for it due to lack of flights.

I am now in a position to go back to Spain  as Ryanair have released some flights my Gestor has emailed me the relevant document confirming my Resedencia.

I’ve been told by a reliable source this document will not get me into Spain and I will need the TIE card?  Has anybody been able to get into the country with this document  or had problems at the airports?

Hi Mark,

For the first month of this year, the Spanish authorities allowed UK citizens to return to Spain without their TIE, so long as they had their "resguardo" confirming approval of their residency application, even though they didn't have the TIE card itself.  However, that grace period now appears to have ended and this is the current advice on the Gov.UK website:

"Additional requirements for UK nationals resident in Spain

"If you are resident in Spain, you should also carry the appropriate proof of residency documents as well as a valid passport when you travel. Spanish authorities have clarified that either the A4-size or credit card sized green EU registration certificates, the “Certificado de Registro de Ciudadano de la Unión Europea”, or the new TIE card, the “Tarjeta de Identidad de Extranjero” are valid proof of residency for UK nationals who wish to return to their homes in Spain.

"The Spanish authorities have not confirmed whether other documents are being accepted as sufficient proof of residence to enable entry to Spain. We strongly advise that you contact your airline before travelling to confirm your proof of residency meets the requirements of your airline."

Hi Kim

I’ve been in touch with the Spanish Consulate who “quote” 

The only documents that are currently being accepted are the TIE card itself and the Green Card. However as it is for the airline to decide they should be able to provide an answer from their side.

I am at a loss now!

Hi Mark,

I'm afraid that I'm not hopeful for you.  Ryanair lists on their website the documents you need to gain entry to each of the destinations and the "resguardo" isn't on the list.  They have their own "Immigration Department" which they state is the final arbiter of whether a passenger is allowed to board a flight or not, but if you read their Terms & Conditions, they make it clear that, should they allow you to board a flight and then you're refused entry at your destination country, you are liable for the cost of being returned to your home country, along with any fine the destination's border control may levy on the airline.  Considering how risk averse BA was, during the period when Spain did accept the "resguardo" for entry, I doubt they'll be any more helpful; and I suspect Easyjet will follow the herd, but may be worth a try?

Have you considered driving and/or train?  It may be easier to get some sense out of Brittany ferries than the low-cost airlines.

I hope you can get this sorted; otherwise, it's a case of sitting tight in the UK until Spain lifts its travel ban on non-resident travellers from the UK.  The country's current State of Alarm is scheduled to last until 9 May 2021, but as the UK's vaccination programme is progressing very well, fingers-crossed Spain will lift the UK ban sooner than that.

If it helps anyone else I’ve just been informed which is on CAB ES site (17th Feb). The Spanish government have released advice regarding additional documentation for entry to Spain. This includes Padron and proof of house deeds,  so it appears I should be ok now.
