I had treatment at vitaelia aesthetics clinic in villamartin and was left with a lump across my lip and a distorted lump on the right side of my face....so I used the Spanish complaints t system but have now been told that according to a particular spanish law they couldn't  do anything and I would need to take them to court knowing damn well the person in the street cannot afford to take legal action against a company with a lot more money than I have......what is the point in having a complaint system if businesses like this are protected by some unfair spanish law?

Sorry to hear of your problem, I hope the unwanted physical effects are only temporary and will resolve themselves in due course.

Do you know the what the "particular Spanish law" is please and who advised you of it?

Thank you for showing interest in my dilemma....the aesthetic doctor actually said maybe I should consider plastic surgery ! This is the translated text from the reply


In accordance with Articles 128 and following Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law on Defence

Consumers and Users all injured have the right to be compensated for

damages caused by the use of a product or service under the terms

established in that rule, but it is a civil liability, that is why

you are informed that you may take any legal action you deem appropriate in court.

I replied asking them what was the point in having an office that deals with complaints if they just tell you to go to court........

Hi Valerie,

Did the doctor suggest you have cosmetic surgery AFTER he'd made a mess of your procedures? 😳

When you say you used "the Spanish complaints system", did you first approach the clinic and ask them for an official complaint form - a book of forms, in triplicate, known as the "Hojas de Reclamaciones"?

Who sent you the response you've copied here, about taking civil legal action?

Sorry for asking so many questions, I'm just trying to understand whether you've covered all bases.

I asked her if there was anything could be done to put right the damage to my face because she had tried various procedures and she obviously couldn't put it right so she said well you could try plastic surgery.....so I said I wanted a complaint form so I could make a formal complaint which I did and enclosed photos and invoices and the paragraph I sent you was the reply.

I appreciate that you are in conversation with Kim regarding your problem but thought I would let you know that the  Consumers Office (OMIC) for Torrevieja Town Hall is based in La Mata Town Hall. They have links  regarding your rights & general  advice  regarding claims etc.( which inevitably  will end up in  court)

Kim may well have more information & help for you but I've added the link so you can have a look. I see you live in Los Balcones & Im assuming you went to a salon in the Torrevieja area otherwise I dont know whether they could help.

Thank you for your input Ellen but it seems no matter what I do i will end up in court which I cannot afford and the aesthetic clinic knows that which is why they have been patronisingly helpful.

The clinic is vitaelia in villamartin and I sent my documentation to alicante as per the instructions on the help notes supplied with the complaints paperwork
