Hi everyone, some background..

We are an early retired couple (we'll both be 61 soon) and we are planning to move to Moraira from the UK in July (so that we spend less than 183 days in Spain this year) but still be eligible for residency prior to end end of "transition". We won't be working in Spain.

We have access to an apartment via a good friend where we have had several holidays, but for residency purposes this time I assume I'll need a formal lease (in Spanish) ? Can you recommend a solicitor / gestor who can provide a simple, acceptable lease (in Spanish with English translation) arrange NIE / Driving licence exchange / registering on the Pardon / residence ?

The intention is to rent my friends place while we look around and find "our" home (6 to 9 months I guess as July and August we will be enjoying the summer and only plan to start looking in September, with completion sometime between January and April.

I'll need to buy a car soon after arrival (might get a hire car for a week upon arrival) but I believe I need an NIE for that, so how can I get an NIE either before or on arrival? Car will be a runabout, not new.

Medical cover, no copay. I believe this has to be in place when I apply for residence, so will arrange that once I'm in Spain. I appreciate everyone's circumstances are different, but is £6000 sufficient budget for 2 people (£3000 each)? Fair health, but we both have high blood pressure and I had a back op a few years ago.

Moving costs - we're (hahahah) are de-cluttering our house which we've lived in for 22 years as It's sold (the July date is deliberate to avoid CGT on the profit of the sale) but will want to ship personal effects to Spain. Do you know of any good, reliable, cost effective movers? We're not bringing any beds, sofa's or big appliances (washing machine etc) as I reckon the transport costs exceed the value of this older furniture. . 

Internet & TV - my fiends apartment doesn't have anything apart from basic Spanish TV but he's agreeable to me doing a cost split on TV / Internet package. Who would you recommend?

Sounds like a plan but one word of caution. 

183 days is one potential indicator of residency but more of a final one than a first, for instance if your UK property was your principal or sole residence then its sale can mean that technically you could be deemed Spanish resident from the day you arrive.

Hi there

It’s a lovely place and I know you will be very happy here. You mention CGT in your mail but you don’t pay any on the profit of the sale of your own home. 
You can also arrange for an NIE number in the UK which you will get from the Spanish Consulate. Take a quick look on the gov.uk site for more info

You senario sounds exactly like ours.  We intend to land around 19th July for the exact reasons of CGT on our house sale here next month.  I've had advice from the 'wonderful' Jim (of Jim's guides) and MyLawyerInSpain, happy to send you my list of questions to them if that helps you, message me personally. 

Finding a good rental is the biggie for us, we have no idea where to start as we also aren't set on any area yet.  We were going to do a rekki in May to try and pin this bit down.  That has been calculated out of our 183 days (hence our 19th July date for moving).

If anyone knows of a good rental agency to work with that'd be helpful.  We are keen on Moraira/Javea and inland to Jalon Valley direction too.

Good luck with all the planning.  Oh btw we did our NIE at the Spanish Consulate in London, used Jim's Guides and on line examples of the paperwork and it worked like a dream.  you have to visit in person.

Hi there,

This is my first but probably not last general post. My husband and I been reading and learning the various aspects of relocating to Spain. Thanks to everyone that has posted good informative, and Jim’s Guide ;)

Our circumstances are similar to traceracing, the original post, in that after many years of consideration, we’re selling U.K. home in a couple months time and arriving in Spain late Sept 20 (one way ferry booked:) Hoping to get residency sorted before end of this year.

Referring to the two replies re residency criteria and CG tax, I would like to clear in my head please.
We have income, private pensions that qualify for residency. If we gain Spanish residency 2020, we will be less than183 in Spain 2020.

Will any profit from U.K. house sale be subject to CGT? It was our only property till we buy in Spain.
At what point should we notify HMRC of our new residency status?

I was just as confused as you, but what I've learnt from this amazing forum is that residencia and being a tax resident are seperate things.  You become a tax resident after 183 days - hence caution on your day count for the CGT on the sale of your home.  YOu can become a resident before this though  and we're aiming for before end of Dec this year (Brexit tranisition period).  Search for Residencia and Tax Resident in the forum, but they are seperate issues.

Thanks for your reply Jill, puts our mind at ease. Much appreciated :)

We will def look at Residencia/Tax on the forum. It’s thanks to the forum information we have already booked an appt at the Edinburgh Spanish consulate to obtain NIE, Jim’s guide has helped with translation on the application.

Like you, we are also looking at doing a rekki on arrival and will rent for a few l months. We have had a few holidays in the Denia area but looking for a permanent home to buy is a different ..and exciting ..prospect!
I’ll pm you as offered for your list of questions please and perhaps you could recommend the solicitor you use?

As part of your research can I suggest that you have a look at Jim's Guides on this site.   The Citizens Advice Bureau Spain can also be helpful.   Just bear in mind that after the 31st January 2020 many things may change.   Also be aware that many provinces and town 'tweek' the national rules and regulations for their own procedures.   

Another helpful site for anything to do with driving in Spain is the N332 website.   This is run in conjunction with officers of the Guardia Civil for English speaking people and has an English version of the Spanish equivalent of the Highway Code.

She will give you a price for all your legal needs, and they are doing our residencia for us for €400, that’s for both of us.

We used Turner insurance ( Lisa McCarthy) in Jávea for health  insurance €2300 for both of us, that is the elite one no excess , I have high blood pressure and am 63 my wife is 61, this is the one required for residency. You have to have at least €7000 per person in the bank. Hope that is helpful. Good luck

Thanks Kev (and all the other posters).

I have gained some very useful knowledge from the forum and am going to apply for our NIE here in the UK in advance of us coming over so I can buy a car shortly after arriving and then work on the Padron / Residency / Driving Licence stuff as well.

I'm still uncertain about a formal lease requirement (to support Padron / Residencey application) as I have conflicting information, so I will get in touch with a solicitor regarding this as neither my friend or I actually want a lease...
