You need to apply for the NLV from the Spanish consulate in the UK.

If you're a UK passport holder looking to make a permanent move to Spain you can apply any time but you first need to apply at one of the Spanish consulates in the UK. If successful you would need to apply in Spain within 3 months of receiving your NLV.

Would you be happy to buy the property as a holiday home if you failed to gain residency?

No we would like to relocate, that’s why I  trying to obtain the fets

It can take some time and is not guaranteed, each person is dealt with as an individual

Also you have to be in the UK to go to London and they hold onto your passports during the review process

Here are the facts....

Since Brexit……

If you are a UK passport holder and you want to live in Spain permanently you will need some sort of visa which are applied for from the Spanish consulate in the London, Manchester or Edinburgh. You must apply for the visa while you are still living in the UK. 

If you want to retire to Spain then you will need to apply for a non lucrative visa. (You are not allowed to work with the non lucrative visa).

To gain a non-lucrative visa you will need to have an income of around €28,000 for the first person and around €6,500 for each additional family member. So for a couple you will need to prove that you have an income of around €34,000 made up from pensions, stocks and shares etc. 

You will need to have full healthcare either by private healthcare (paid for a full year) or, if you are receiving UK retirement pension, you can apply for the S1 healthcare scheme which is paid for by the UK government. Healthcare must be in place when applying for the NLV. There will be a couple of other documents that you need to provide like your marriage certificate translated into Spanish and a police background check report. 

If you want to live in Spain permanently and work then you need to apply for and secure a position first and then your prospective employer will need to apply for a work visa on your behalf from  the Spanish consulate in the UK. All work positions available must be offered to an EU citizen first, by law. 

When you have gained your visa you can then move to Spain and apply for residency within the first month of arrival otherwise your visa will become void. Your initial visa will be for a year and then you will need to reapply for another NLV at years 2 and 4 also proving your income is stable. After 5 years you will become permanent residents.

Unless the rules have changed, and I can find no evidence that they have, there are problems with that statement.

Firstly DWP will only send S1's to non UK addresses so assuming you were entitled to one you would need to know someone in Spain who could receive it and post it back to you. DWP do not check addresses or require proof that you live there so not an insurmountable problem.

What is more problematic is to register an S1 in Spain requires you to be resident for which you would need to produce your TIE however to apply for that requires you to show health care is in place NOT just that you are entitled to apply for it so it's an impossible catch 22.

I've asked the question whether anyone has successfully acquired their TIE solely on the strength of an S1 before but have yet to receive a reply either way.

Yes darro but you need to update your information........

I think you will find that the S1 can now be sent to a UK address for use in applying for a non lucrative visa.

It's not as bad as it sounds, just loads of hoops to jump through. Many people have successfully applied, it's just not as easy as it was prior to 2020.
