UK State Pension.

I've been a Spanish resident for over five years and am married to a Spanish citizen. She if fully employed. I am retired and have recently claimed my basic state pension from the UK. This is paid monthly into my Spanish bank account. Can anyone advise me as to whether I need to declare this to the Spanish authorities. In short is my UK state pension taxable in Spain.

Sadly, yes. They will tax you for those five years and fine you for late returns! Simply you are liable for tax in the country that you reside in. You can claim four years tax back from the UK to sweeten the pill!

You need to inform the Spanish tax authorities of all income whether it's from Spain,  UK or anywhere else in the world!

Have you filled in the Duel taxation forms that stops you paying taxes both here and UK?

If you've never filed a resident's tax return, then you'd better do so, as you're in breach of the regulations, and Hacienda could have at you!

It also might be worth asking if you need to complete the form Modelo 720 if you've not done so already.
