Hi there. 

First of all, my apologies if this has been asked many times already here, but I cannot seem to search back in the archives via my phone. 

I have bought an apartment in Oliva and will be moving over in the next few months. I have a British passport - and I'm in the process of applying for an Irish one too (in case it makes things any easier whenever Brexit happens), so I will be dual nationality. I am self-employed and plan to continue this in Oliva. I'm considering this to be a permanent move to Spain, and have been learning Spanish in preparation for the move. 

Can someone please outline the process for what I need to do when I move over, in terms of Padron / registering myself etc? Having bought the apartment earlier this year I'm already paying Iberdrola for electrics and taxes to the town, so I'm 'on the books' somewhere. And I have my NIE number also.

Registering on the Padrón is a bit of a grey area.

In theory, the law says you can only register on the padrón if you are a resident. Having said that, some towns have been keen to enrol nonresidents as it increases their income from Valencia by showing more residents in the town.

The documents you need for the padrón include passport, NIE and the copia simple of your property. Take these to your ayuntamiento and see if they will enrol you. If not, you will have to wait until you get residencia, or a TIE as it will probably be by then.

If you have an Irish passport you will probably be able to get residencia fairly easily as an EU citizens. UK citizens will lose that right as soon as brexit happens, so go with the Irish straight away.

You will need to show proof of monthly income and also have medical insurance that satisfies the regulations. If you are earning and paying into the INSS, that will be covered, otherwise you will need to take out private medical insurance, at least for the first year, and show a monthly income of 700 € or more into a Spanish bank account. Sometimes the figure is higher, sometimes they accept a UK bank account, but you will need a Spanish one anyway for work.

To work as self employed, as you intend, you will need to register as autónomo with the ayuntamiento and also register with the INSS and Agencia Tributaria for tax and insurance. You will be required to make monthly contributions to the INSS and pay tax, I believe quarterly. I may be wrong on that last bit. Anyway, you have to employ an asesor to handle your tax as autónomo.

By paying into the INSS you have health cover and this affects what you need for residencia, if you see what I mean.

Brexit has changed some of the rules and, at the moment, it is very difficult to get residency as a brit, hence my suggestion you use an Irish nationality.
