Can someone clarify this for me please?

I went to Spain for 90 days but came back early and only stayed 30 of the 90 days in one go and returned to the UK. Do I count the 90 days I have to spend in the UK from the day I arrived back in the UK from Spain or do I have to wait the 90 day period that I should have been in Spain and add the 90 days in the UK before going back

Thanks?

As far as I know, Spanish controls, if any, aren't that strict. And there is always a so calles "Permanencia", a permit to extend your stay. In case of doubt, check with the State Police. If you look for them, they are very friendly, if they look for you.... who knows?

Hi

Your passport is stamped when entering and leaving Spain from the UK, so my view is, it is always best to follow the 90 day rule

We use this on line calculator to confirm our thinking when planning our stays https://www.visa-calculator.com/

I hope this helps

Sue

Hi Elizabeth

To many people are complicating this when its not difficult to fathom, the best and easiest way would be to get one of the many apps, download to your phone or computer enter the dates in and out it will keep you right, I use schengen calculator free.

As in your case forget about you were going for 90 days but cut it short that doesn't matter its the time you enter any schengen country the clock starts ticking, by that the I mean the 90 day allowance starts aslong as in the previous 90 days you havent entered any other schengen country, once you leave that is calculated as your allowable days, dont forget this is rolling so if you spend x amount of days in the UK then you only go back 90 days from the day you expect to enter a schengen country again as to how many allowable days ypu have to stay.

Hope this helps...

Try using this website to plot in your past / future trips - it’s the simplest I’ve come across so far

Has anyone any real information of the effect of overstaying?

The 90 rule has been in for over 18 months

There must be examples of people overstaying the 90 days, or are UK citizens just good and keep to the rules

Chances of getting caught overstaying the 90 day rule are small at the moment but the new systems being brought in later this year and next year will dramatically increase the risk of getting caught

The penalty, if caught, means that you can be banned FROM ALL SCHENGEN COUNTRIES, for up to 3 years

Ask yourself if it is worth the gamble.
