Termination of rental property on Roda Golf.

We have rented a 3 bed holiday  Villa on Roda Golf for the past 30 months. Visiting twice a month from England. Because of the Virus situation we have not paid the rent to the landlord since March. He has offered us 2 free months April May , but wants half rent for June July 450 euros per month .  Then August back to full rent of 900 euros, I cannot see any way we can justify paying the rent when we cannot get flights to the region and really don’t see any real way this year we can visit with confidence. 
We have personal belongings, clothes , some furniture, expensive Rattan garden furniture, 2 new bikes, 3 sets of golf clubs. Is there any one local to a Roda Golf who could collect and store our belongings. We have had a good relationship with the agent and landlord but we feel we have no other option but to give the keys back at the landlords request. Anybody got any ideas please?

Hi Ray thanks for your comments. Yes we have thought long and hard of the “right thing to do”  . We have no formal contract in place , we had one up till last November but we held back signing a new one asking for some necessary external renovations To be done, so we paid monthly until March. We and you Can only guess what’s going to happen over the coming months! Second wave etc. I only can say here in England everything is on hold including life and we have had banks suspend mortgage payments, government help with Furloughing . Big financial sacrifices all round. Even if we were living in the property I would be asking for the landlords help. We have had a good relationship and do not wish to sour it any more. We need to store our belongings and wait and see what happens before deciding to long term let again. We love the Mar Menor and hope one day it returns to some normality.

I agree with Ray.

Clearly, you are not short of a bob or two and could afford to continue paying.  Things will get better. Perhaps you could re negotiate with the owner and explain that at present to cannot see yourself returning and it’s highly unlikely that the owner will find suitable and willing renters as things stand. Now would be the perfect time for the owner to do the work required to the exterior of his property.

Your possessions...  There are people on the forum who transport furniture etc.,back to the UK so if you made contact with one of them, they could carry it back for you. 

Being a golfer, you seem to have found the perfect location for you and your family to stay while in Spain.

Perhaps you and your wife are self isolating and loath to travel anywhere. That being the case, you have reached the decision and subconsciously don’t want to leave home.  Arrange to have your property collected and carried to the UK.

We have a house over in Torrevieja and are paying numerous bills including WiFi, Netflix, car park undercover, car insurance, urbanisation charges and more and WE aren’t even allowed to visit it!   In the big picture, this is a hiccup.  Life MUST go on and will return to normal within the next 3 or 4 months, it has to.  Humans cannot live the way these experts are advising ie using face masks , social distancing up to 6feet, no dining or relaxing with friends in company , schools teaching our children in small groups. Utter madness. No matter what happens, life has to go on. 

We listen to constant complaints about how our government handled things but obviously they are blindly going about doing their best to make the best decisions to keep us all safe. It’s so easy to see the mistakes afterwards but not so simple at the time. 

The warm/ hot weather should discourage the virus from spreading and yes, a second wave will likely happen BUT our NHS have learnt how to deal with it much better than they did at the start. Ventilators are a last resort.  We will get there and you could be back in Spain playing golf in the sunshine next winter, maybe you’ll have had your vaccination by then. 

Talk with your landlord and agree on some civilised plan.  Give it another 6 months!

If Spanish law is anything like UK law in this type of situation, the fact that the contract has expired will not matter as you both ( you and the landlord ) have continued to act as if there is a contract in place.
Your landlord may possibly have been able to benefit from state aid for landlords but nonetheless  you still need to empty the property if you decide to end the rental.
If you scroll down through the posts there is an advert for a business which does van hire and cleaning in Torrevieja so I imagine they could help you out and can give the property a good clean before you hand it back.

Hi Grannyrose , I agree with you entirely, this horrendous situation could not have been predicted. Fear, in trepidation , wondering what it will be like going to the airport? Masks! Gloves! Mr O’Leary describing his planes as aluminium tubes! How can he guarantee social distancing, impossible! A second Spike, my wife is the associate director of Southport and Ormskirk Hospital trust and the last two months has been planning for the inevitable second wave. 

As you say the government have done their level best in trying to deal with the total unknown, can’t do right for doing wrong! Every decision is questioned by gutter press making it seem a whole lot worse than it really is!

Thank you Cheryl, yes we really don’t want to get into any legal wrangling of what we should and shouldn’t do! This situation could never have been predicted and it’s neither the landlords or my fault we cannot visit Roda as normal. I I’ll scroll down and try to find the contact. Thanks 👍🆑

Clynch.......I have to agree with Ray in such that the Landlord has been more than fair.

If you didn't sign your new contract, and if Spanish contracts are the same as UK then you would be on a rolling contract. In the UK this is ususally on a monthly basis where both sides can give notice to leave. This notice period is what is stated in the contract.

I do however totally sympathise with your predicament but nobody could have accounted for this unprecedented situation.

The landlord might also be relying on this money to cover his Bill's. Not all Landlords are well off.

I hope you manage to amicably sort out the situation.
