 Hello    !!   Neibhour  nr.12   and    neighbour  nr.13 .

   I,m  a  president  of  community  in  Playa  Flamenca  - of  28  units , not  by  choice  !   Now   there  is  a  huge  problems  between   2  neighbors  , about   dividing  wall. In  the  fall       this  family  in   Nr.12    build  illegally [no agreement  with  community  or  me , no licence ] big  terrace , fenced   with  1.30 cm  from  their  side  . Next  door  neighbor  nr.13  , without  any  agreement    end  up  with  wall of  2.45 cm    blocking   one  and  only  entire   view  from  the  pool,   green    area ..  Those  people  are in  their  80th, living  there  16 years  ,  and  are  devastated .Nr.13    complain  to  me  ,  cry, talk-wanting  to    take  wall  down .   I  check  with  our  administrator ,  we   had  a  meeting ,  and  one  resolution  is  to    take a lawyer ,  and  fight  with  nr.12. for  next  3-5  years .   I  had  a  meeting   with  nr.12  builder/contractor   and  owners -  I  was  told  that --  all  was  build  legally ,   they  do  not  need  permit ,their  fence  is  legal   1.30cm ,  and   it  is  a  nr.13   ,,that  have    stupid  demand  and  -  more . I,m  not   going to  repeat  what  they  said  .  What  rights  do  have  nr.13 -  according  the   law ??   Lawyer  at  admin.   said   that  they  have  to   have  mutual  agreement  --  that  never   happen  and  never  will,  they   swearing  at  each other . Now ,,, is     there  a  paragraph  in   Planning  division,     in  Town Hall --    [that   would  be  Playa  Flamenca   Town hall ],   saying   that  in  community   other  side  of  the  dividing  wall    can  not  be  higher  then  160cm/180cm,  measuring   from  the  ground    ??

Is  there  anything    that  could  be  done ? Nr.13  is  willing  to  pay  and  take  wall   down ,  and   fight  more  for  more  months . Would  you    have   any  smart  solution ??Is  there   a  side online , [in English]  from  town hall   showing   sizes/height   of  the  wall  that   I  could   print  it , !   Do  you   know  anybody   [planner,architect[$]   who  would  know  and  could  help  ??   I  must  say  that  I,m  new   at  this ,   we  bought  a  house   there 1 1/2   ego   and  same  year   at the   AGM meeting , they  drew  us  as  a  position of  a president , no one  wanted  to  be  one .     Lately ,  I  was  trying  to  study  Horizontal  law  ,   and  I  know  that  nr.12  is  wrong ,         wall   from  one  side  is  to   tall --  but    I would  not  like   to  have  police  on  our  urbanization .  Nr.  12  is  not  living  there -  only  holiday  home  ,  nr.13  in  there    everyday .  It  is   just  not     nice   situation.  .   Please  ,any  ideas  ?? .  Thank  you  for  your   time  and  suggestions   .

If it was me I would dismantle the wall and see where it goes from there, if they rebuild I would remove it every time they would I should imagine give up in the end.

Hi boguszewicz, welcome to the Forum.

You have my sympathies being dragged into that dispute, however as you took on the role of Presidente ,then mediating in the situationsit is one of the functions of your job. You could consider to resign from the position and leave the two warring neighbours to it 

Another solution could be to retain your position and quietly suggest to neighbour No13 to arrange to knock down the wall whilst neighbour No.12 is out of the country. Let No 12 then call the Police if they wish.

If, as likely,  the wall is rebuilt, the same action should again be taken.

Might be worth checking if the Community has a set of adopted rules. Theses are rules that you agree to abide by when buying a property in a Community, and usually include stuff like this - building new exterior walls! Sometimes rules get "lost". Check with other owners, check with the Administrator who should have one in any case. If and when you find one, and it does exclude this kind of behaviour, show it to the owners who built the wall. Give them a copy and a deadline to remove the wall, after which get the wall down!

Thank  you  very  much   for  your   answers  .  Yes ,   MRT 1973 -  that  would  be  my  idea  if  that    be  my  wall. At   this  point    just   gathering ideas .

RayD -  I   left    visit   and   denuncia  to  Town Hall as  a  last  results . 

LeckyLes - apparently  drew  for  president   is  "by  the    horizontal  law "  that  99%  people  do  knot   know  about  it  .  I  was  one  of  them .You   MUST -   be one  for  a  year .Thank  you   for   sympathy   ,   feels  better   !! 

You  could   not  resign . I did   fight   for  a  months. Wall  issue  -- at  the  moment  I,m  trying  to  find    print [law]  about  leagall sizes  of  the  walls . 

operationdinne rout -  all  was  checked ,  meeting   with  admin.  lawyer  was  done ,  meeting  with  bad neighbor  and  her contractor   was  done . According  to  them -   they   right .They   try  to  scared  me ,  other neighbor, now   they  working  on  administrator  trying  to  scared  them  with  the  court -     lots  of  bad  emails .In  December  Admin.  and  me  send  them  email  with  demanding  to   take  wall  down  by  15th of  Dec . ,,,,,,,,,  well ,   that  was   a  ticking  bomb.  I,m  not   going  into   the  details   what  was  said .  So,      3   results  left -  wall  down , town Hall , Court -and  5  years  fighting . Thank  you  for  your  time  !!

Hi boguszewicz,

What a horrible situation for you to have to arbitrate, you have my sympathy. 

Some friends of ours have a similar problem.  Their neighbour has built a 2.3m wall without permission and has left it unrendered on our friends' side.  Our friends tried to reach agreement with their neighbours, but relations broke down.  The architect at our Town Hall has confirmed that the maximum height allowed is 1.8m, so our friends have submitted a formal complaint to the Town Hall and await the architect to take enforcement action against their neighbours.  

I think the owners of Nr. 13 need to make a formal complaint about Nr. 12's development to their Town Hall.  Whatever community rules you have, they do not supersede planning regulations.

Perhaps you could tackle this another way: if the residents at Nr. 12 are saying their development is legal, you could tell them that, as President, you need a copy of the permission they obtained from the Town Hall for your records.  There's no such thing as "permitted development rights" in Spain, as we have in the UK, so for their development to be legal, they must be able to provide you with a copy of the planning permission - either a Minor Works Licence or more likely for the extent of work you've described, a Major Works Licence.

Thank  you  Kim ,    I,ll    see  what   I  can  do -as  far  as  I  know ,   from  talking  to      their   contractor ,    they  have   no  documents  . Contractor [Spanish}  said -   they  do  not  need  it  since  it  is  on  ""there,s  property ""   --   baloony  !!

Typical response from contractors - they don't care about the legalities, they just want the work.

So, what to do next?  I think the owners of Nr 13, along with the community administrators, need to denounce the owners of Nr 12 and ask the Town Hall to take enforcement action against Nr 12.  The alternative would be for Nr 13 to take legal action, but subject to the rules of the community, Nr 13 may look to the community administrators to assume that responsibility - and the cost.
