Hi Janice,

My friends who arrived on Monday don't have residency either - they had started the process earlier in the year and were due to go to Alicante on 26th March, but Covid-19 scuppered that.  They were allowed entry to Spain on the basis of force majeure, as I described above.  Depending on...

... your circumstances, you may be able to do the same thing.

By the way, your partner doesn't have to be of pensionable age to apply for residency.

Stay safe,

Kim

Thank you, Kim.

The thing is he would no longer have an income if he left the U.K. now and applied for residency in Spain. Plus health cover is a concern. He won’t get his pension till September 2021 so I guess we’ll have difficulty getting him resident anyway due to the financial restrictions in place. I’m going to have to be very clever here to work something out!!!

Hi Les,

Well, it was said as a joke, but if I remember correctly from Jim's guides - which he has very helpfully updated today - the financial requirements for Residencia for couples is less than the total for 2 individuals?  So perhaps not a joke.... 🤔

Stay safe (has the lovely Bles seen your response yet? 😄),

I might just do that! It could resolve a lot of problems and I think we both felt that we would do it eventually anyway. Now seems like the right time.

Thanks for all your help xx

Kim,

You mentioned force majeure and I remember seeing a letter from the British Embassy which you could present at borders going back to the UK from Spain. Is there such a thing for Going to Spain from the UK does that mean?

No there is not, in fact, quite the opposite.

The Foreign and Commonwealth Office (FCO) advise against all international travel.

The FCO (as well as the embassy in the UK and Spain) has been very blinkered in any response and do not consider any personal circumstance, merely point you back to their website.

Also, remember you will not have valid travel insurance due to the FCO advice.

I would suggest you sit tight and hold on to see what the next 3 weeks brings about.

Good luck and best wishes.

edit - I meant to add in, as per my other posts, that you cannot be stopped from making a journey to return the country who have issued your passport, hence why there is a difference between leaving the UK and returning to the UK. Hope that makes sense

Hi Janice,

No, there is no form to show at the Spanish border - the only official documentation is the "attestation letter" which the French authorities require for travelling overland through France.

Whilst HandyMan is correct when he says that the FCO advise against all international travel, it also states that there are exceptions to this advice: people who are Spanish citizens or Spanish residents returning to their home, or force majeure.  When I drafted letters for another member in March and for my friends who arrived last week, it was on the basis of force majeure.  Both of them were arriving at land borders, not airports, and in both cases, their primary (only) residence is in Spain.

Regarding travel insurance, I would recommend you check that point with your insurers: if you're travelling for reasons of force majeure, for which the FCO advice makes exception, it's only your insurers who can advise whether they would honour your cover.

Kind regards,

Kim

Hi,

Looking for some information, if anyone can help?

My partner and I have a rental property in Spain and the lease will expire June 30th, We initially took the lease for 6 months and due to coronavirus we have only managed to use the property for three weeks in January. Due to the uncertainty around travel and our current  financial situation we have sadly decided not to renew the lease.  I believe our landlord has new tenants ready to move in ASAP.

Given these circumstances, our intention was to travel from the UK to Spain (via France) in our van, chill and enjoy our last few days in the property, pack up our belongings then return  to the UK before 30th June - would this qualify as essential travel ?? Our biggest concern is we have very expensive electric mountain bikes in the property.

We have our NIE numbers, Spanish bank account and pardon for the region  but obviously no residency.

Due to the UK Government latest update regarding quarantine my partner would now travel alone. Can anyone offer us advice on travel restrictions, border control and certificate for essential travel ?

Many thanks

Hi, I know this is a silly question, have you asked the landlord if they could postpone the new tenant to the second week in July and you will be able to travel regardless. As all international travel is allow after 1st July, which I believe is all forms of travel.   Also someone else mentioned wiseguy removals highly recommended www.wiseguysremovals.com and speak to Andy.  Hope this helps x
