Hi Everyone

I completed on my quad villa in October 2018 though I was very unhappy with my lawyer who I mistakenly engaged to do the work. He is also based in Malaga which was another problem. - The deeds finally arrived 2 weeks ago they had taken a year to come through. I have now received an email from this same lawyer informing me I need to pay 11.11 Euro plus their fee of 150 Euro.

Can anyone advise on this please. Do I have to retain this lawyer and is there another way I can pay the 11.11 Euro requested. I'm non resident and don't let out the property.

Thanks for your help.

Julie

It depends on the sort of agreement you had with the lawyer. If that included him doing taxes then you're stuck with it this time, but I suggest you send him a recorded delivery letter discharging his services for the future. If there wasn't any agreement, and he's just trying to take advantage of you, then tell him to tickle off and see what he says. You've still got time to get your tax return done a lot cheaper.

I told you a year ago about Spanish Tax Forms for doing your non-resident return, but since then I've found a cheaper and better way:

Incidentally, even if it's only for two months, €11 sounds a bit on the low side.

Hi Jim

Thanks very much for your email.  I would very much like to use the firm that you recommend and have emailed my lawyer to that effect. However I'm not 100% sure whether or not I agreed that Patricia would complete my Tax affairs. - In the end I just wanted to complete on the house and would probably have agreed to anything.  Hopefully she will send an email acknowledging mine. She said in the email that I need to make payment to my bank by 15/11. Does this sound like a probable date?

Is there a way that I can ascertain if the 11.11 euro amount is correct? My lawyer has made a lot of mistakes in the past.

Thanks again for your help.

Julie

If you pay directly via a bank, then you have until December 31st. If you give the tax office authority to take the money by direct debit from your bank account, then the return has to be in by December 23rd.

Part one of my guide tells you how to calculate it:

https://www.costablancaforum.com/area/almorad%C3%AD-spain-11/taxes-suma-nie-tax-advice-in-almorad%C3%AD-25/jims-guide-non-resident-tax-part-1-theory-no-rental-income-75479/

I need to go to the tax office when I've time, to talk to them about when 1.1% should be used, as my interpretation of the law is different to that used by Angar, who still use 2% in the majority of cases.
