Hi, I am considering becoming a Spanish Resident in order to overcome any restrictions to visiting Spain post Brexit but I am a bit concerned how it affects my freedom to visit the UK. Does anybody know if there are any restrictions to visiting the UK or what the general rules are ? I own a house in both Spain and the UK and I am British.
If you spend more than 90 consecutive days in Spain, or at the start of your visit you anticipate that you will, you are required to sign on the foreigners register in other words become resident ( frequently and incorrectly referred to as"residencia").
This has no effect whatsoever on your coming and going to the UK.
If you spend more than 183 days in total in a calendar year in Spain then you are automatically considered a tax resident.

Just read your reply. I have never heard of a foreigners register. People always go on about Residencia. Could you please tell me how to sign on to the register.

I am not quite sure what you mean.You can own property in both UK & Spain but can be a fiscal resident here thereby declaring your tax liabilities in this country. Consult a Gestor,the person who deals with the Hacienda who will set you right..Many of us have owned property in another country yet elect to have our tax done in Spain.Although I no longer have any property in UK,I do have a bank account in Sterling in Gibraltar which is declared & my Gestor reports this on my tax return.

The Spanish tax year runs from 1st January to the 31st December.
You can declare your income for that period in the following year if you wish and also notify the UK revenue of this. Although, if you rent out your dwelling in the UK then they will want to tax that income as well.
It is, so I believe, a relatively straightforward procedure to " deregister" should you want to in the future.

So if I want this formalised before Brexit what do I need to ask my Spanish Solicitor for ? Is it foreigners register signup or residencia or tax residency ? My aim is free movement between the UK and Spain rather than tax preference. I would like to spend more than 6 months in Spain but would like the freedom to visit the U.K. without restrictions.
Tell him that you wish to register as a foreign, E.U., resident of Spain, this is signing on to the foreigners register. Jim's guide is a useful place to look ( ,https://www.costablancaforum.com/area/almoradí-spain-11/residency-in-almoradí-padron-residencia-passport-advice-23/), but essentially you will need to show that you have sufficient financial resources and healthcare to prevent you becoming a burden on the state. It's a simple procedure once you have all the necessary pieces in place.
Advise him of your wish to become tax resident as well and be prepared to declare your worldwide assets in excess of 50K Euros. As I said, the tax year is January to December.
