Hi 

Can anyone please help. We arrived in Spain September 2020. We tried to get a appointment at the Town hall to register for a Padron, we were unsuccessful. We submitted our application for residency sending all the required documentation (private health care, financial information,  bank acc. rental contract,). The application was rejected. We then appealed the decision sending supporting documentation to prove we were residing in Spain prior to the December 2020 deadline. We are still waiting to hear the outcome of our appeal.

We have been adviced to get a appointment at the immigration office for information on our situation but have been unable to get an appointment. We have been told to submit another application using a professional body (solicitor). I had an appointment with a solicitor who told us we would be wasting our time if we did not have a Padron.

Can you kindly advise if this correct and if there is evidence that others have applied for residency without a Padron

Unfortunately your solicitor is correct. The most common reasons for rejection of residency applications (under WA) by the Alicante immigration office are: 

(1) No full health care provision dated prior to 31st December 2020 

(2) No padron dated prior to 31st December 2020 (although this was never a requirement outside the Valencia region)

I've heard that some gestors were caught changing the dates on the padron to try to circumvent the rules and are being investigated by the immigration authorities. I don't know what has happened to the applicants but I believe at least one gestor was arrested.

There are organisations that are paid by the UK government to help people in your position. Babelia is one of them, take a look at their website at https://asociacionbabelia.org/en/uk-nationals/ There is no charge and they may provide better assistance than your solicitor.

Getting appts for official Depts in Spain takes perseverance & patience ( especially as  Brexit was looming at the end of the year) every dept was extremely busy.. It was doable though - I know at least 5 people who got their padron In Torrevieja  during last few months of last year and obtained there TIE cards......not sure where you were applying but Playa Flamenca town hall had seemed easier at the time.

 From what Ive read on the forum, solicitors vary  with the advice they are giving, but making money anyway so not really affected.

I too would have suggested Babelia but I see you've been down that road. Keep us up to date if you make any progress
