Good morning,

Desperately need some help and advice please. We, and several of our neighbours are at our witts end. Tenants have been living next to us on and off for the last two years, this year it seems permanently. They have been warned about the noise which starts at 7.30am until our community curfew ( they obviously know some rules) but recently it’s got so much worse. It seems now that” their” house is now the local hotspot for vodka drinking day and night. Their child is left to her own devices and runs around screaming all day with no remonstration. The Administrator doesn’t have contact details for the owner and we don’t know what to do next. They are verbally abusive to other neighbours who complain and so the get away with it day after day. My husband has said that’s it and he doesn’t want to come back here any more, it’s a nightmare situation. We have had a holiday home here for 20 years and loved every visit. 

So any help is very much appreciated.

How disappointing that you are getting no help from your community president. I've found the following for you https://www.abacoadvisers.com/spain-explained/life-in-spain/news/problems-noise-in-spain but it may be helpful to let your community president know beforehand just in case he/she can do something about it but would just prefer not to have to.

Call the police they can’t be allowed to get away with that .. Go to the president it’s their job they get free 600 to 800 Euro a year for this job 

I wish you well if you are renting which I hope you are then look around for another rental in playa flamenca where we live is so peaceful 

You deserve a better deal than this ... I suppose if you all got together and put some money in you could go to an English speaking lawyer and there is always the town hall

Hi everyone, thank you so much for your replies. Our President and Administrator know about this horrendous situation as it’s not just us affected. The reply today from the Administrator regarding previous complaint was “The owner didn’t reply to her” so she just left it. Our neighbour who is also Russian said to us last night that normally she would go round and have a word,  but she doesn’t want to because of the type of people they are. She obviously hears everything they say and their language is appalling especially in front of the child. 

As I speak to you the husband and three of his burley friends have just returned with supplies so we are in for another noisy evening, yay 2 more have arrived. When we complained to them directly a year ago one of the guys stuck his head over our wall and asked us what our problem was. So now the shouting at each other, they call it talking, starts. The more drunk they get the louder it will be, and then amazingly stop just before midnight. We now can’t sit in the garden. We have to close the windows to watch tv. We live in a detached house in a lovely road and we’ve been very happy up until 2 years ago. we just about coped when they went back and forth but now the child is in school, there’s no escape.

Please don’t give up there is a man on here called Jim and he has written a terrific article on living in playa flamenca am sure he will know what to do what he doesn’t know you could put on the back of a postage stamp think it called also a girl called Nicola who has lived here for a long time she got rid of nasty neighbors we had she looked at there house and was able to tell them what wasn’t legal they left a month later and. We have nice neighbors now .... nieghbours can break or make your life there must be something even if it means moving for the sake of peace

Isn’t it amazing when you buy a house and are given the community rules, you abide by them (more or less, maybe an occasional slip up)  and all neighbours are amenable. Then the unthinkable happens, tenants from hell and your life is literally ruined overnight. Trying to find the original owner is like trying to find Lord Lucan!!! My husband has emailed the Administrator again today, Nada.

Isn’t it the responsibility of the Administrator/President to have these contact details in case of emergency etc for all owners?

We are going back to UK in a few weeks so I don’t think this will be resolved before then.

Your community should all email the president

Call the police that’s why they are here and they do there job well

Do not let these louts take over your life

This is a very common story. A friend of mine had a similar issue and long story short, the local police advice was if you have a problem call us. Whether they do anything is another debate altogether.

The long story......

A friend of mine had tenants above him, never any problem. Then new tenants moved in below him. Two female residents joined later by 3 men. They played very loud drill music and drum and bass at all hours of the day, and then at 2.00am when they returned from their "nightime" activities. They also had a dog that howled a lot and was never walked. The smell of marijuana stunk out his apartment as it was coming up from the terrace and through the vents. They started dealing. My friend went to the police and complained,  the police told him it was legal to possess marijuana for personal use. Go away basically. Then he recorded the noise and put the video on the community WhatsApp group. The owner saw it and things quietened down for a few days before returning to normal.

Later that week a police officer started parking his car opposite the apartment overnight and quite soon most of the occupants moved out. Later in the month the National Police raided the apartment and found 6kg of hash hidden in the bathroom ceiling cavity. Handcuffs and away!

The problem is really at what stage does noise intrusion cross the line from what the Spanish would describe as "normal" loud behaviour to become behaviour that is not acceptable. Seems you are at the latter. If you get no joy with your President keep going to the police. Any other residents neighbouring suffering too? Try to persuade them to go with you?
