Tourism Licence obtained - what next?

Hi all

We have recently obtained our tourism licence for our property in Playa Flamenca, and now (I understand) need to register with the local police to set up an on-line portal to register visitor details with the local police, as a means of the authorities having information of people visiting, and for the tax authorities to access in case of any issues down the line when we declare our rental income as part of the landlord non-resident tax submission. 

I have sent an e-mail to the local Gusrdia in Playa Flamenca (as per instructions on our licence confirmation letter), but have received the following reply 

“ Good morning from Orihuela Police Station.

 You must go to the Civil Guard Barracks in Pilar de la Horadada.

 Thank you.”

Has anybody else in our position encountered this, as the instructions on our licence, and previous topics on this forum, seem to indicate that the station at Playa Flamenca is the one to deal with?

Yes, for Playa Flamenca you register with the Guardia Civil, the station is on the sea front near the old tower in Torre de La Horadada.

You will need to take your license, NIEs  and passports.

You also need to buy your official plaque and a pack of official complaints forms. The plaque and the official notice saying you have the official complaints forms need to be displayed just inside by your main door.

Have you taken out specialist holiday let insurance with full public liability cover?

Your keyholder/cleaner must be registered to work in Spain.

Ensure you display your license number on all ads.

If you are non residents you need to file your tax return in Spain each quarter - tax payable immediately. This has to be done within 2 weeks of the end of the quarter.  You will also need to declare your rental income and the tax paid in your home country.

Thanks Davebev, I’ll get in touch with them today to hopefully book an appointment in the near future. I am aware of the other requirements ref non-resident tax returns on a quarterly basis, and will be speaking with our home insurer to change our policy to cover holiday letting.

To be honest, we are not, we will not be actively pushing to rent the home out, it’s just a potential extra source of income and having the licence in place gives us piece of mind that if required, we can legally it out

I think the hardware shop in La Florida does them still.  There is a template available that they work too.  The complains forms I actually got via our solicitor as easier because they are government forms you order then pay for and then collect, I just didn't have the time! so asked my solicitor to get them for me and collected them on my next visit.

Are you asking about the actual license or about the certificate you get from the Town Hall first so that you can apply for the license?  If you are wating on Orihuela Costa Town Hall for the certificate then you will wait a lot longer I'm afraid.  I have heard of people waiting over a year.  Once you have that and all your other documentation together it is just a few weeks wait for the license application to be processed.  The two are separate applications - the first is dealt with by the Town Hall (compatibility certificate) and the second (the actual License application) is by the tourist office in Alicante.

We first started the process in July/Aug 2018, using a local Property Management company to submit the initial application, and then follow it through. I believe that there were a few rule changes along the way, which prolonged the process, and we eventually received our licence on 20th November 2019 - so all in all approx about 15 months.

The change regarding the need for a certificate from the Town Hall happened in July 2018, with almost no warning, so you would have been caufght up with the start of that - if you had applied a couple of months earlier you would not have needed to involve the Town Hall.  Prior to July 2018 you only applied to the Tourist Office in Alicante.  The requirement for Tourist licenses became compulsory in June 2015 and for the first 3 years you just sent the application and relevent documents off to Alicante.  For the first two and half years it was really quick, just a few weeks, but in January 2018 they announced the clampdown on illegal letting and the office was immediately swamped with applications.  It seems there were thousands letting illegally up until then and there was a panic to 'get legal'!  The Alicante office got back-logged and things were taking 6+ months, but then 18 months later they brought in the Town Hall stage.  I don't think any of the Town Halls were ready and by the time they got their acts together there was a massive back log.  Some still only view it as low priority so haven't even got a member of staff working on it most of the time.   The up side is that Alicante have now caught up with their applications so the second stage is now back to being quite quick.

All in all ours took around 12 months to come though and yes the first part was the longest around 10 of those months - We got our plague at the Hardware store on Cabo Riog Roundabout sorry can't remember what its called of the top of my head!
