Hi  I would like to know the law regarding children under the age of 12 swimming in th adult pool even with armbands and toddlers? We have a notice stating must be aged 12. But surely does not mean they can be in charge of two little non swimmers.

What is position of the community if something goes wrong. I keep telling all parent it is not allowed. And now it seems they are all 12 or older. Guess me have a lot of little people with growth problems?

Never mind the law and what is the position of the community if something goes wrong. What about the position of the drowned child whatever age.

All children have different abilities. You may have a child aged 12 who is hopeless at swimming. and because the law says whatever and the community ''I am in charge idiot'' puts up a notice saying whatever, does that absolve everyone including the parents from neglect and the child's death.

Common sense and responsibility seem to becoming more rare these days, but swilling lager seems a bigger priority.

I agree totally. I worry so much. I see people on their roofs and at the back of their house and small children with arm bands left in the pool....crazy! 

I have pulled my hair out trying to tell them and we have the rules written up. But I need to know if a community is liable legally. And then I can fight my case to be extra vigilant on this with our president.  We are a new community and it's very difficult to get holidaymakers to obey the rules. It has to be written in stone. 

I read today that a community can be fined up to 60,000 euros and pool closed for 5 years. If it true I will ask for this message to be sent to all owners.

I haven't got time to research the various laws regarding public pools, but I can give you one example.

Royal Decree 742/2013, 27 September, regulates the technical-sanitary criteria of swimming pools.

The official bulletin is BOE-A-2013-10580

Article 5 clause 2 says: The owner of the pool must ensure that its facilities have the right elements to prevent risks to health and ensure the safety of the facilities.

My interpretation: the owner is the community, and that community has a legal responsibility to ensure the pool is safe to use.

The law also says at Article 14:

The owner of the pool will make available to users, in an accessible and easily visible place, at least the following information:

d) Information on the chemicals and compounds used in the treatment.

e) Information about the existence or otherwise of a lifeguard, and addresses and telephone numbers of the nearest health centres and emergency numbers.

f) The rules for use of the pool and rights and duties of users of the same.

Hi Jim good post, but the law can only do so much.

What about the parents that say ''we bought Jimmy plastic water wings at the TODO shop for 1 euro'' so job done, we are off to swill more lager.

Sadly if anything went wrong, these parents would blame everyone but themselves. Lets go get a no win no fee lawyer.

There will never be an answer to irresponsible idiots, its just part of life and the Brits are not shy at contributing their share.
