On Monday I gave out paperwork to the abogadis to renew our visa for the next 2 years,thought it would be straight forward but have had an email today requesting a new marriage certificate as it has to be issued within 6 months,then it goes to the haigh for apostle. We have been married for 42 years,have a monthly income of 2,500 Euro which will increase by 700 Euro in October when I get my state pension  Between us we have 5 pensions,1 house here which is paid for ,2 houses in the UK,only 1 with a small mortgage. All were disclosed but they are requesting further documentation. Is this correct or am I getting false information.

It is surprising they are asking for a new marriage certificate, perhaps for some reason they require a marriage certificate with Apostille applied within the last  6 months. (The marriage Certificate does not change same as Birth certificates).  I have heard other stories of the Authorities asking for documentation outside of the VISA Renewal Application Requirements.

Not sure why you submitted some much Financial information?  all you had to do was show you had access to the IPREM for 2022 for next two years.   The other information they require could be bank statements/Utility bills etc for past six months to prove that you were resident in the country for last 6 months.

I strongly recommend you speak to a Tax advisor urgently as you have inadvertently exposed all your Worldwide assets to the Spanish Authorities, You need expert advice now on your up and coming tax liabilities that could be due to Spain.

When you become tax resident in Spain, if you have an asset valued in excess of €50k in any one of the 3 asset classes, you must declare all your worldwide assets on rhe Modelo 720, prior to submitting the annual Modelo 100 tax return.  So eileen36 hasn't "inadvertently" disclosed anything that they wouldn't have to disclose on their Modelo 720 anyway.  Unless you're suggesting they commit tax fraud? 😳

I am NOT suggesting any such thing, i am advising her to speak to a Tax Advisor.  I resent your accusation.  But not unexpected from those that rule this forum.

I was advised by my spanish lawyer not to advise the authorities of worldly assets, leave that to the tax advisors when the modelo 720 is due if you spent more than 183 days in spain in a tax year.

Also declaration of your worldly assets is NOT necessary for VISA renewal,  whoever advised her to do so is misinforming people.

Thank you,I have declared everything to my tax advisor and paid my tax.We had a meeting with the solicitor this morning who is putting our renewal paperwork through as two separate people as they find it strange that they are asking for an updated marriage licence. They may comeback and still request a licence with an issue date but doing it this way gives us time to request one from the UK and get it sent to us here .

Hi Douglas,

No-one "rules" this forum except Alex, the owner and moderator.

As with anyone applying for a NLV, Eileen has provided the required financial proof - this is not specifically defined by the Spanish Government.  Whether we like it or not, the Spanish Consulates in the UK can ask for what they want to satisfy themselves that an applicant will not be a burden on the State.  We even have examples from members of how the extent of this proof can vary from one Consulate to another.  To suggest that Eileen has "inadvertently exposed" all her "Worldwide assets to the Spanish Authorities" is alarmist - she did no more than she would have to do for her Modelo 720, which she's confirmed has already been done.
