T.I.E Card restrictions

Hiah all, how long are you allowed to stay out of Spain in the 1st 5 years of your T.I.E card ie the full total over 5 year period i have heard 10 months but am not sure. Thanks Billy

Not more than 6 months in the first year and a total of 12 months across the 5 years.An NLV, and resultant Tie, is an application to permanently reside in Spain not a workaround for the 90/180 day rule.

Note also that if you are out of Spain for longer than the specified time you will loose your Residencia status and will have to start the process from scratch

This is a previous post from Kimmy11 which explains that if you obtained residency after 1/1/21 then the limit is 10 months, not 12.

"As a UK citizen who gained Spanish residency prior to 31 December 2020, you are protected by the Withdrawal Agreement.  As you have been resident less than 5 years (temporary residency), you can leave Spain for no more than 182 days (i.e. 6 months) during each of the first 5 years of residency, and no more than a total of 12 months in the 5 year period.  There is one exception, whereby you can leave for a continuous period of up to 1 year for vital reasons, e.g. sickness, pregnancy, etc. (The same limits apply to people who have obtained residency visas since 1 January 2021, with the exception that they cannot leave for more than a total of 10 months in the first 5 years.)

After 5 years, when your residency becomes "permanente", you can leave for a maximum period of a continuous 2 year period."

I got my T.I.E. card on July 2020 so I should be ok for 12 months in 1st 5 years Thanks Cheryl
