I have a few friends who are now worried , because they have not applied for Residency and I have tried to help, but it seems the regulations for showing your have a certain amount of money in your bank account, is outside their remit. What do they do now?.they are now classed as illegal immigrants and are worried about what happens to them ?..what actually would happen to them. Awkward question but I would like to pass on some good advice. Thank you in advance.
Since Brexit all applications need to start at the Spanish Consulate in the UK so nothing they can do from Spain, firstly they must return to the UK to start the process.
In my opinion it does not bode well for them or anyone else in the same position as the situation they find themselves in usually catches up with them making things worse.

TIE for UK Nationals, Those who can prove they were living here before the 31st December 2020 can still apply for the TIE under the withdrawal agreement conditions. They must provide proof of the following, Padron, Property deeds or Rental contract, Passport, Passport photos, Bank Statements, Certificate of bank balance, Proof of income, Medical protection, all must be up to date and must show Historic dates prior to the 31st December. They will have to prove the capacity to live on the income they receive and UK Bank accounts will be excepted as proof prior 31st December 2020, re historic dates.

Hi all in my humble opinion ,i would suggest things will calm down next year ,as spain cannot afford for no residencies ,we are two of them

Oh, you have been a resident for x years, you owe us a lot of back tax, and we are going to charger it to your assets if you do not pay up.

I do not understand why firstly you did not do the right thing and register your residency.
Why Spain you think will bend for the few people who flouted the laws on residency and therefore tax.

And the Spanish state will be right in saying thank you & good riddance - anybody avoiding paying tax by living under the radar deserves to be hit with a back payment covering what they owe - plus fines - if/when they get caught. If you break the rules, you have to accept the consequences if caught - no good pleading innocence or being afraid of getting kicked out as a non-resident

Looks like steve and jan above are in for a surprise.

But the 'sort of people' who were and are under the radar are going to find a way to get back to the UK and afterward sort out there Spanish affairs saying they were not resident, and paying a small amout of Non resident tax.
Not the 'sort of people' that any country needs.
