Residency and brexit

Hi, we have a place in la siesta that we are planning on staying in more than 3 months of the year and also own a property in the UK that we live in for the rest of the time (we also work in the UK). I am wondering what we should do in terms of residency as Brexit is fast approaching. Does anyone have any advice or know of any of the Brexit breakfast meets we can attend within the next few weeks?

Thanks Pete 

We could split it 50 50 between UK and Spain as my work is home based anyway, so it would only be going home to see family etc. I will be honest I am getting a little confused as what is best due to the so many conflicting posts around the web  and have no idea what the best thing to do is :)

For once I disagree with Pete, as there are two classes of residency - temporary and permanent. If you intend to stay for more than three months, you need to go through the EX-18 application process and apply for temporary residency, the requirements for which are not as stringent as for permanent residency.

On a quick look at the legislation, the following applies whilst the UK is still in the EU:

Real Decreto 240/2007

CAPÍTULO III

Estancia y residencia

Artículo 7. Residencia superior a tres meses de ciudadanos de un Estado miembro de la Unión Europea

1. Los ciudadanos de un Estado miembro de la Unión Europea o de otro Estado parte en el Acuerdo sobre el Espacio Económico Europeo tienen derecho a residir en territorio español por un período superior a tres meses. Los interesados estarán obligados a solicitar personalmente ante la Oficina de Extranjeros de la provincia donde pretendan permanecer o fijar su residencia o, en su defecto, ante la Comisaría de Policía correspondiente, su inscripción en el Registro Central de Extranjeros. Dicha solicitud deberá presentarse en el plazo de tres meses contados desde la fecha de entrada en España, siéndole expedido de forma inmediata un certificado de registro en el que constará el nombre, nacionalidad y domicilio de la persona registrada, su número de identidad de extranjero, y la fecha de registro.

And:

Orden PRE/1490/2012

Artículo 1. Derecho de residencia superior a tres meses.

Los ciudadanos de un Estado miembro de la Unión Europea o de otros Estados parte en el Acuerdo sobre el Espacio Económico Europeo y de Suiza tienen derecho de residencia en España por un periodo superior a tres meses si cumplen las condiciones previstas en el artículo 7 del Real Decreto 240/2007, de 16 de febrero, sobre entrada, libre circulación y residencia en España de ciudadanos de los Estados miembros de la Unión Europea y de otros Estados parte en el Acuerdo sobre el Espacio Económico Europeo.

I must admit that I can't envisage any situation in which such registration would be advantageous to either the individual or Spain.

With Brexit in mind, I'd also point out that there are a lot of residents in Spain who didn't come from EU member countries.

I think that Pete is giving you an up to date picture.Yes,Jim, there are lots of non EU nationals living here,I live amongst a huge group of Norwegians but they are,if I can be frank, have more cash to splash than us Brits.I can sit on the fence as I have a Spanish pension but still don't have a clue how things will pan out for British Nationals.If you have attended any of the Consulate meetings that have been held in the province,you will see that we are only being quoted what we can learn by reading the Govn.comments or from English TV.Perhaps you could join one of the groups like "Brexpats" who try to keep us aware of things .I believe that they are also in contact with the likes of Guy Verhofstat who supports us.

Hi Debra - I don’t know if you are aware that you cannot split residency 50/50 with the UK, it’s either one or the other and if you opt for Spanish then there is a large amount of criteria that must be met, as Jim and others have previously commented on

As an Irish citizen my advice is not to worry too much about Brexit at all. The UK Govt are intent in trying to force so many silly demands on the EU that they continually get sent back to Westminster to think again. May has to try and appease every rebel faction within her party and Corbyn looks clueless on the whole matter. The only sense. thus far, has come from the Lib Dems and the SNP.

In the meantime life will go on and in a number of years I suspect all of the EU will be in the same position.   Meanwhile the opportunists will have made their money during the uncertainty and then in about 4/5 yrs either a second vote will happen or the UK will just drop the whole farcial thing over time.

So relax, enjoy the sun and your second home.
