Do I need planning permission to enclose my solarium?

I want to enclose my solarium which at the moment is open on one side. I thought to put in sliding doors, but would I need planning permission as I am, in effect, making another room?

Yes you will need permission, it will be either a minor or major works permit depending on what exactly needs to be done and what the town hall say. You may even need an architect to sign off on the works but I would go to the town hall first with the plans for what you want to do and see what they say.

Hi well in Spain the law is whatever the local councils nake on the day, we enclosed our balcony in about 8 years ago nothing was sais and so has about a hundred or more in this urbanisation untill one day oast year at our anual meeting there was a guy from our company that does all the legal stuff and he had an architect we were told that we all had to pay up to 500 euros tax.

well a year on and nothing has happened and we wete told by our local solicitor not to pay anything so the ones that paid the architect to look at the properties were given there monies back.

so be carefull and take legal advice before paying anyone up front.

Thanks Pete. I had wondered about having to get 'permission' from the administrator of our very small gated community as well as from the town hall. No-one can see the area in question so there should be no objections (hummmm) but I am concerned that the town hall will think I am creating another bedroom, so I had better take advice from them.

Trust me you do have to get permission now, i have 4 jobs to look at and they all need surveying, two consist on changing a window to a double door, so does not matter how small or big, remember anything structural, it has to eventually be put on the escitura (deeds)

if you use a reputable window company like euroguard they will advize and help you through process.

We are just selling our house which has 2 glassed in areas.

At the time they were done the Spanish company who did them told us we did not need planning permission as they were not a permanent structure -WRONG! We also followed our community rules which said we had to get permission from the President and our neighbours -WRONG again! We pay a Spanish administrator a lot of money each year to ensure we keep to the Spanish law and he has never told us any of this is incorrect.

Whilst selling we asked various agents if we would need a new habitacion certificate and were told that our original one was enough, its from 2003, WRONG!

Through no fault of our own  - we consider we took advice from the so-called professionals - we are now in the position of having to either get our improvement agreed at the next AGM for the community  ( until then there will be a retention from the proceeds of the sale) as should have been done in the first place and a new habitacion certificate and also apply to the Town Hall for licences - which are likely to be quite expensive. Who knows if we will also be fined for this. We are on a very short time frame now for completion and, of course, we now have the Easter break which will delay matters further.

One other thing - when you do get your permission agreed make sure you keep copies! We have had changes of Presidents and no one knows where all the paperwork is from 2008 and, as we thought this was long ago sorted out, we have no copy of it either.

What a mess!
