Hi there . Thanks fir your message . my question is : I have stayed at my apartment many times during the past 2 years . To apply for residency do I need to be staying in Spain continuously for a predetermined amount of days ? I’m still working here in the U.K. until I retire next April but wanted to see if I can get residency before Brexit .

Hello

Yes you have to live here permanently before you can apply for residencia and be able to prove it by registering on the town hall padron.... having regular  monthly payments and /or a set balance  in your spanish bank account. I can't give you the figures as they are likely to increase considerably in January 2021. There are other requirements regarding health, either an SI from DWP in UK if you are pension age or private health insurance for a year.

Check again in the new year when we all know better & someone can give the correct details

We've been going back and forward for a few years now and finally decided to stay out for a year, we're now at the start of the process and we have to provide a pension statement showing 700 euros a month or 9000 euros each in a Spanish bank, we're not pension age yet so we're transferring the 18000. We're also looking for the best priced private health insurance, the going rate seems to be 1000 euros each. It's a complicated business, probably more so in our case as I'm 63 and although I don't get a state pension yet, I've paid enough in contributions to receive a full pension, however my wife is only 56 and needs to work some more years to qualify for a state pension,  so we will have to go back but we want to get our residencias before brexit.

As stated previously, you have to be a resident to be able to apply for residency.

Be careful about how much time you spend away from Spain as it will invalidate your residential status if you leave Spain for too long.  You do have be living mainly in Spain to retain your right to be residents.  Can your wife not make voluntary contributions to make up her missing years for her UK pension?

Good morning .Thank you so much for you comments on my post . I have got padron as well which I got on 24th September. Do you think that if I go back on 13th November or before December is there a minimum number of days I have to be in Spain before I can start the process ? 
is there a lawyer you can recommend to help me get the ball running ?    I have started claiming my U.K. pension already (although I have a part time job which I might give up due to the pandemic ) and I can prove earnings and bank account balance at Sabadell . I just need to get insurance sorted out . Any other tips greatly appreciated . Thank you
