Dear Reader,

About a year ago we emigrated to spain. We needed a bank. In order to get an account sabadel CO-sold a home-insurance. 120 euro a year. This year almost ended and I am  in a procedure to cancel this insurance. They majke it very hard on me. I went to the bank signed a form to cancel the homeinsurance. Now they want me also to phone the insurance (one year ago they sold us rhis insurance without needing us to phone them). The insurance dies not answer the phone and when they answer the english speaking person is not there. To cancel an insurance BY PHONE has not much legal validity hoewever...The Sabadel Bank tells us that the insurance ciompany does NOT do business by email! Because we asked the Sabadel to ask their insurance company to contact  us by our emailadress... I have NO adress of this insurance company. No policy either.So my question: Does anybody has a suggestion how I can cancel this insurance EFFECTIVELY? Regards, Ronald

Hi

I was in the same situation with the same bank, I went online stopped direct debit then went into the branch to advise them. The bank told me that I would receive a phone call which I did receive it’s just the usual retention phone call. I explained that I had a better quote and signed up with the company. No money was taken and policy was cancelled but this has to been done one month before your policy is due to end.

As Lana says, the law is that insurance companies are entitled to one month prior notice if a policy is to be cancelled. The only sure way to give notice is by a recorded delivery letter.

Some insurance companies will accept less notice, but you would need to check the conditions in your policy to see what it says about cancellation.

I was in a similar situation after my first year here, but unlike you I did have the paperwork from Sabadell for the home insurance policy. I sent a cancellation letter (in Spanish, courtesy of Google translate) to the person named on the policy covering letter at the bank's insurance company, which was up in Sabadell near Barcelona, and I sent a copy to the lady in the Denia branch that originally sold me the policy. This was done before the time limit, and it worked.

I think its disgraceful how the banks and other financial institutions behave. Sometimes you just can't win and to say that they don't accept emails but a phone call is outrageous. In these modern times email should be an accepted. In my eyes Sabadelle should do the cancellation as they sold the policy in the first place and earned the commission, but unfortunately they dont give a monkey's chuff.

The comments on here appears to be sound advice..........but as usual everyone wants to hold on to the business and make it as difficult as possible for you to escape.

I definitely would be sending an email, recorded delivery letter, take a duplicate letter into the bank and get it stamped and then cancel the direct debit. If they then reinstate the DD you will have a good case.

Sometimes it just makes your blood boil. I can't stand when you get quoted about T&C's.

Shame about the Ombudsman. I have used them myself recently and they were exemplary and voted in my favour regarding a scammed payment.

Off subject a bit but........ I had to get them involved as my bank released funds to a third party company after me paying for an item. Because my bank and the receiving bank were the same group (HSBC) I asked them to check them out due to the value of the purchase being nearly 14K. My bank was First Direct and they came back to me two days later and confirmed they were bonafide and the security checks were ok. I told them to release funds on this basis.

After not receiving the item I contacted my bank who basically said that it's not their fault and would not be refunding my money! Consequently I got the Ombudsman involved and it took them 12 months to investigate and listen to the calls etc etc. I got every penny back plus interest and compensation. As you can imagine I took great pleasure in calling my bank to say thanks......in the process of now reducing my balance to £1.

Hi Ronald

Unfortunately, I think I threw out all documentation related to this insurance a few months after after cancelling it. The only thing I've still got on computer records is the address I sent the cancellation letter to:

BanSabadell Seguros Generales, Calle Sena 12, PIAE Can Sant Joan, 08174 Sant Cugat del Vallès

Maybe you should just stop the direct payment from the bank with online banking. I had to block my payment because they would not send me out my renewal notice. I emailed Sabadell, my reply was I need to go into the bank. I went into the bank and last week when I was in spain and they told me I need to call them. I have not got round to it yet. Hope you get it sorted.
