Hi thinking of obtaining an Irish passport.  After research on Internet, understand I need to register my birth before I can apply for a passport and there is at least a 2 year backlog.  Grandfather Irish. Have dismissed this previously as my husband has no Irish ancestry and therefore thought there was no point if he cannot travel with me.  Does anyone know if after I have an Irish passport, can my husband travel with me and therefore stay in Spain for longer than 90 days.

I know all European countries are only meant to stay 90 days but before Brexit even us Brits were turned a blind eye upon.  Its only now we are out that it's strict.

Even with an Irish passport you are still required to fill in the foreigners register within the first 90 days of arrival in Spain. There may be consequences if caught out.

No, that would only apply if you became Spanish resident otherwise you are both tourists and with a UK passport a stay of over 90 days would brand him an overstayer and make him liable to penalties which range from fines to bans on re-entering the Schengen area for up to 3 years.

Sorry but this is not workaround for the 90 day rule, many have searched for that but none have yet found one.

Thank you.  I know all the penalties for overstaying.  I just find it rather coincidental that the thousands of UK people who have obtained Irish passports are married to partners of Irish descent also!!!!!

Never mind. 2 x 3 months is better than zero!!

A lot of people who have applied and gained Irish passports are people who want to come and live permanently without all the financial and healthcare requirements. As you know its simple arrangement when you have Irish and EU passports. The married partners who have UK passports are then allowed to join their married partner to apply for residency.

Thank you Steve.

I shall just have to obtain a French 6 month tourist visa and then visit Spain for 4 months and France for 2.

As far as I am aware ( I am in a very similar situation wife is Irish)

The 90/180Rule does not Apply to you or your husband as you are both vested  with the rights of free movement.

As previously stated you are supposed to report your presence if you intend to stay longer than 90 days however this has largely been ignored.

Legally you could stay for 90 days leave for one day and then return the next day and that would not be a problem.

Interesting! Thank you.

'both vested with the rights of free movement'

Please explain as I guess your wife has Irish passport and you don't.
