Asking 2 month deposit

Hello. 

I am about move to a new house, and the women who representing my future landlord asking for 2 month deposit, and cleaning fee.

We did not ask to clean the house. It was landlords friend who did it for him. Also I'm not sure if 2 month deposit is legal in Spain (internet says it is not) That's my third house in Spain and no one asked me for 2 month before. She representing him as private person not as agent, but she does work for agency. 

The whole deal was pretty straight forward on till he took her on board.

Now 2 weeks before moving she throws additional charges on us.

Can any advice me on that, please.

It all depemds of what says your contract. Usual practice is that deposits are rarely, not to say never, reiumbursed. Agents, reps or whatever want their pick. One month's rent deposit is ok, 2 months is a bit much, 3 months = stay away.

I have never had any problems with getting my deposits returned but then I have never dealt with an agency but directly with the owner. The maximum deposit I have paid is 2 months and if you have the funds, I treat it like savings but without interest.

I did not get my deposit back in my very first apartment in Santa Pola. But then we learned that there's a custom here (in some places) that you don't pay the very last rent and this is your deposit back.

As soon as I informed my landlord at that time that we moving out he cut off all the communication.

Not great experience.

I would speak to the landlord. Whatever deposit you pay should be agreed when you view the property and should be written in the contract, if it's not then I wouldn't pay it. I definitely would not give the money to someone witout an invoice and a receipt, if I agreed to pay I'd pay the landlord and let him pay her. It's a contract and everything you agree with the landlord should be in it.  If she works for an agency you should get a bill and a receipt for any money paid from the agency with it's registration number on it. If she's just doing it for him as a friend then she shouldn't be taking money from anyone. About the cleaning fee - any property you move in to should be clean, you shouldn't have to pay to clean anyone else's mess. If you decide to pay this she should provide you with an invoice and a receipt for payment.  Check the contract to see what it says about cleaning. But I guess it all depends on how much you want this particular property. Personally, I'd walk away from anyone who throws things like this at me at the last moment. I wouldn't have any confidence about how things would go if there's a problem in the future. I've rented here for years and have always received back the deposits paid and never had to pay for cleaning.

Contract is not done yet. She just said that if we don't pay those money we not getting the keys. The problem is I can't afford it now, if they told me that 6 weeks ago I wouldn't even look at the house. We agreed on the rent but the same time we just assumed it will be one month deposit not 2.

This is exactly what we know. We have rented in many countries and we never come across this kind of circus.

I think it's her not him.
