Good afternoon. 

Could someone tell me what local licences or permits are required (local regulations) to obtain a temporary rental registration number in Santa Pola, I'm thinking of renting out my property.Thanks

Best of luck getting a tourist licence at the minute. There have been massive changes this year. Are you in a house, community or apartment?

There are two types of short term rental. The first is holiday rentals for which you need a Tourist License. These are now very hard to obtain; first you will need permission from your community (unless you you have a stand alone villa); then apply at the Town Hall for Compatibility Certificate for which you need to produce the community permission, a valid habitation certificate, deeds (nota simpla is fine), certified copies of your passport and NIE.  Your property will need to comply with all the requirements in respect of equipment and facilities at the property, which includes having wifi, air con in lounge, fire extinguishers, evacuation plan, first aid kit, emergency numbers, tourist info, all bedding and towels, fully equipped kitchen inc extractor fan, tv, and a few other things.  Once you have the Compatibility Certificate you can apply for the Tourist License, for which you also require a valid EPC.

Once you have the License you buy your official plaque, your official complaints book, register on the SES Hospedajes system so you can enter all guests' details on arrival, register your intended rental periods on the GVA site. If you intend to use advertising platforms to obtain bookings then you will also need to obtain a Tourist NRA.  Holiday stays are currently limited to 10 nights in Valencia region.  You need holiday let insurance.  The max number of guests is dependent on the size of your property so check the License for those details. You will need a keyholding and cleaning service and must let the entire property, not just part of it.  All advertising must include your Tourist License number.  The rental price must include ALL utilities, TV, wifi and air con.

The other type of short term renting is seasonal. You don't need a License but will need a non-tourist NRA if you intend to use platforms.  Seasonal letting is NOT  for holiday use - you would be renting to people who need temporary accommodation for a non-holiday reason for anything from 11 days to 11 months.  This type of rental comes under LAU laws so different type of contract, legally set minimum deposit required which must be paid over to the official GVA account not held by you.  You would need landlord insurance for short stays, not a holiday let policy.  You cannot advertise for holiday use or on holiday only platforms.

In both cases you are required to file your annual tax return and pay tax on the rental income in Spain. 

Fines for illegal letting are huge.

Now find a dark room and lie down for a week before you tackle all the rules, regulations and paperwork  :) :)  You will be paying 24% tax on rental income if you are non-EU.  Or 19% if EU. The good news if you are non-EU is you can now offset receipted running costs from your rental income. Do you still want to go down the tourist letting route?
