Non res tax

Good evening.call me ignorant.but i.v been here 10 years a did not no about paying non residant tax.i only found out when i went to the bank because it.s been took over again.i was never told about it when i first baught the place.has any body been in my position.if you have can you tell me what you did.i have herd that when you sell it they may fine you and get the tax then.i feel i may get arested when i go to the airport appreciate a reply.

I would suggest with your personal circumstances in mind, you initially pay for some professional advice from a solicitor. It will obviously entail some cost, but not excessive compared to the potential consequences. Just pay for an initial consultation, they will explain your options. Then you can make your own decision on which way you want to go. But it will be based on professional advice, not peoples opinions. You will most likely get replies asking how could you possibly allow this to happen, also pointing out the potential consequences and so on. But the best way forward right now is to get some professional advice.

By all means consult a lawyer but what's done is done and I'm not sure there is much they could do in mitigation or to minimise any penalties.

Personally I think I'd be more inclined to approach the tax office directly to fess up and throw myself at their mercy. They are not ogres and for sure will have dealt with the situation many times before.

Thank you, i.m going to see a lawyer.i would not no where the tax office is.my first lawyer never told me this.but i.m responsible for it so i will have to take it on the chin.i,m exspecting a fine with 4 years back tax with interest i.m sure it has happened to other people i would like them to tell me what happened to them.kind regards.ds

I would be tempted to employ a gester to submit your non res tax for this year, I think you've got until the end of December for this years submission. Then play it by ear, you may be lucky and they just accept it. If not, then you've a few years back payment and fines & interest to pay but it's not a massive amount.

You mentioned non - residential fax - have you got a home over in Spain that you use for holidays, long breaks etc and is not your permanent home, which I an presuming is back in the UK?

I don,t rent it out.i lock it down i come over 4 times a year at a time.i.v always payed my suma tax which i get letters for in november and emails but i never had any letters about non res tax i.m sure they must be other people in the same boat .i only found out on friday and will be seeing a lawyer tomorrow,  or at least getting things going i will keep this forum posted to let other people no what happens.ds thank you.

You are doing the right thing in addressing it now, before the authorities start chasing your and adding costs onto your outstanding balance.

Can I suggest you contact Spanish Tax Forms at [email protected] - they do my annual NR returns every year, and may be able to advise if missed payments that you should have done can be paid now? This will save you the cost of using a lawyer, at least in the first instance?
