BBVA Bank refusing info on my late fathers account.

My father passed in 2007. I have finally got the deeds switched over to my + my brothers name. However the process has fractured our relationship and my brother is uncooperative and won’t speak to me. We were told in 2007 that there was no money in my Dads BBVA account by the solicitor PSB in Torrevieja and they froze it. The whole process has been difficult and PSB have in my opinion put barriers in the way, but to be fair, my brother has been extremely difficult. 

I have recently been advised by PSB that there is money in my fathers account. However they say in order to release it they need an up to date copy of my brothers passport which he is refusing to provide. They have a copy of his old one.

My main concern at this point is that they are refusing to say what is remaining balance. PSB say they won’t tell them, even though they have P.O.A.

Does anyone know if this is legal and OK for the bank to withhold this information from me as one of the beneficiaries as they have all my paperwork.

Does this "all my paperwork" include a "declarción de herederos" and "aceptación de herencia" set up by a Spanish notary public?

Among Spaniards it's common use that whenever someone dies, whoever has access to his account will immediately take away all the money.

Thanks, but that doesn’t make any sense at all!

My Dad was not spanish.

He had a spanish will and yes all paperwork completed.

You seem to imply “someone” may have taken money.

Not a helpful reply, I’m more confused than before LOL
