How long can my parents stay in the UK

Hi 

My parents are residents in Spain and very happy there.

Have UK passports,and officially retired.

But how long can they spend in the UK for in a 12 month period?

They like to spend 4 months with me during the hot summer in Spain.

Hi Tim,

Are your parents "residencia temporal" (less than 5 years), or "residencia permanente" (more than 5 years)?  If they've been resident for less than 5 years, they can't leave Spain for more than 183 days in each of those 5 years without losing their residency.  If they have lived in Spain for more than 5 years and so have "permanente" status, they retain their residency so long as they don't leave Spain for more than 2 consecutive years.

Hi kim 

Appreciate that.

They have been residents for 12 years.

I was wondering how long they can spend in the UK?

As I know I can spend just 3 months in Spain with them ( Europe) due to Brexit.

Hi Tim,

You're talking about Schengen rules.  As a Third Country National resident in the UK, you can't spend more than 90 days in a rolling 180 days in the Schengen zone.   Similarly, your parents, as UK citizens, despite their legal residence in Spain, have to comply with the 90/180 rule when visiting other Schengen countries.  However, the UK is not (and never has been) in Schengen and, as UK citizens, your parents can stay as long as they like in the UK, but in their case, for visits to the UK, it's Spanish residency law that is relevant, not Schengen.
