I am posting in behalf of my dear friend.

She has a Spanish passport, lived in Wales with her partner for a few years (they have small kids in common) and moved to Spain in March. As they were not a married couple, they were told at the townhall that the easiest way for him to be able to stay in Spain was to get married. Everything got organised, but it took them almost 3 months to get married. (due to paperwork etc) I was a witness at their civil wedding, but before that I was interviewed by the athorities in order to confirm that they were a real couple.

They got married in June, and she thought that everything would be ok after that so she did not apply for a residency green card/certificate for him. She now has contacted the foreign office and nobody can tell her whether he is legally here or not (one person says he should fill in a form, another one says he should fill in a different form...) It is all a bit confusing....

Because they did not apply for the green certificate straight away after the wedding, now they worry about the consequences.... (they started the process now)

Could he get fined? Is he legally here?

I appreciate any info, or if somebody knows about a gestor or lawyer who could help? The lawyer they went to was asking them for 1500€....
