Hi All,

Just looking for advice regarding purchasing a property in Lago Jardin 1, Los Balcones.

I’ve seen a post on here saying never to give a holding deposit to the agent. Can anyone please let me know if this is correct? Should I pay a holding deposit to my Solicitor? The agent asked for a 3k holding deposit just to take it off the market. 

And also given the recent flooding, are ground floor apartments with a large patio at risk of flooding into the apartment?  

Any info greatly appreciated, thanks so much.. Sharon

Yes, use your own choice of lawyer, not the estate agents one. You do not need to pay anything to the estate agent, make all payments through your own lawyer. 

The 3k "holding deposit" isn't a legal requirement, but you may find the vendor won't take the property off the market without that commitment, but pay it to your own lawyer on the basis that they will refund you if the purchase doesn't proceed.

Never  give  a  Penny to Estate agents  as in  most  cases that is part of  Estate agents  Commission. 

Give  3000 euros  to your own Solicitors  to take  property  off market and get Solicitors  to do searches  on Property  to see if  any Finance   owned on Property.  Community fee  up  to date  Suma  .

I would  not  open a Spanish Bank account 😒  too  expensive.  I  would lodge  Purchase  funds  into Solicitors  Holdings  account  or Escrow  account. On  Completion  day Solicitors   can use his account  to  get a Banking  Draft  to pay  balance  at Notary  office.  You  could use Power of attorney  as it  saves  a  lot of  hassle  and inconvenience.  I  have  used above method  to purchase  my  wee  Casa. No  problem  were encountered  and not   too far  away from  your  area

Hi  Sharon. 

If  you are in Torrevieja  presently.  Why don't  you  make it your  business to contact  President  of Community  of your  intended  purchase  and enquiry  with him about flooding.  I  also  try to contact  permanent  Residents  and enquiry  with them. As  you  cannot  beat Local knowledge

I’m in Ireland & ideally I’d like to purchase after living in the area for six months but I just don’t have the time however will do my detective work upon viewing the property & before I put a deposit down with the solicitor..
