Complaint Against Letting Agent

Hi All

How do I go about making a formal complaint against a letting agent? Is there an authorised body that handles these issues or is it a department in the local town hall? Or indeed someone else altogether?

Basically I rented a property in Torrevieja and the agent has taken a chunk of my deposit for a reason that I disagree with. I have asked them to justify this expense but they are just ignoring my emails. I would like to sort it out with the company but it would be useful to know what my next step might be if that isn't possible so I was hoping someone might be able to give me some information.

Many thanks for your reply. I actually think I am dealing with one of the better of the bad bunch. They did at least return most of my deposit and it's not a huge figure that they owe me. I just hate it when they charge for something they obviously haven't done, don't bother to reply to emails and just assume they will get away with it.

I am back for another 3 months soon so I will pay them a visit if they dont respond to my latest email asking for clarification.

This time I am using an agent who was recommended to me and so far they have been brilliant.

Hi

You have to ask for their complaints book, a requirement by law, fill it in on their premises, either in Spanish preferably or English. 

You can now take the WHITE original, plus photocopies of the receipts, guarantees, and any other documents you believe relevant, to the ‘Oficinas Municipales de Información al Consumidor’ or the Town Hall. Another way of submitting the documents is by Burofax - A fax system run by ‘Correos’ post office for the delivery of official documents.

An official mediation process will be set up, and you will be contacted by post with a result, from anything between two weeks leading up to four months. In the meantime we recommend to keep all the documents, together with the GREEN copy in a safe place.

Many thanks for that information, it is very helpful.

The letting agent has finally responded to an email ! However they have failed to answer my questions !!

It seems fairly clear they can't substantiate the charges they have taken from my deposit. What I have to weigh up is whether it is worth the hassle to pursue it.

At least I now know the process involved thanks to you.

Good morning Paul...That's EXACTLY what they want you to do: NOT persue this matter!

This is how they 'get away with it'! They really do need to be made an example of!

These people, like a lot of other leeches, don't care about YOUR personal circumstances, and as I stated in my earlier post, there is NO control in place for these 'white collar thieves'.

Maybe someone can take this up for you, to attempt to 'bring these people to book'!

Paul, please understand, that there are MANY more such as yourself, but NOTHING is being done to alleviate these problems.

There is NO 'Trades Description Act' in this part of the world, Nor is there a 'Consumer Protection' element in place, so basically, MANY people are being 'screwed' into the ground, with NO chance of recompense.

Maybe our good friend: Jim Taylor could step in and advise...Take care Paul...🅱️.
