Hello, forum,

I registered here just a few minutes ago. 

I am looking for a notary who is able to rewrite my father's apartment for 100% to me. Of course, my Father gives his okay. I asked 3 notaries. Every notary says something else. One says, he needs an energy-efficient certificate. The other one says she does not need this and the third one even does not know what it is. While I am searching for a 4th notary, I am looking to find a way how to pay the tax. 

Unfortunately, the city hall doesn't have an email address. I tried to call them, they pushed me away. I went to the building but the person did not speak English. So I hope to find someone here, who can help me. What kind of tax do I need to pay, when I want to rewrite an apartment from my father to me and who is the receiver (f.e. maybe suma?)

Maybe someone can recommend me a notary with a little bit more know-how too. Between Murcia and Alicante. Or (in case the notary is a dream up to Benidorm)

 Rather than a notary, I think, for the various things you need to change/register for, a gestor would be your best bet. They do deal with everything and usually cheaper than solicitors

My personal recommendation would be www.getlegalinspain.com Uma and her team, all speak English & are excellent - many people on this forum have used their services with great success....Give them a call

You may find that this alters your father’s tax position, as he would then be in a position of usufruct, ie enjoying the benefits of the property without owning it. My mother and I wanted to do this some years ago and were advised by the abogada and the notario that this is not as simple as it may at first appear, and financially would not be worthwhile. Would strongly suggest you consult a lawyer as these kind of transactions here are totally different to that which may apply in UK.

@Stephanie86: the tax position is not so important for us, because we are eu-citizen. As I could find out the most things concerning real estate ownership is not cheap like in other countries. My father is angry as a duck, that he bought this property here.

Why not have him make a will leaving the property to you.   The inheritance tax etc are not too frightening as you are his son.   Ask a gestoria or go direct to a.notary to make out the will.  €50.

It is not a tax. It is a simple energy cert which all properties which are being sold must have.  It costs about €100 and there are lots of registered firms doing it. They must visit the apartment  to do their measurements.  Here is one which comes highly recommended.

As regards transfer of property to children. The Comm Valenciana now has very favourable tax concessions so the tax is not as penal as it once was.
