Hi all,  My wife and I are looking to move to Spain from the UK in September this year. I have an Irish Passport and my wife has a UK Passport. I understand gaining residency under these circumstances will be quite straight forward with the appropriate documents. What appears to be more complicated is we will be hoping to bring my wife's father with us. My father in law is 76 and registered disabled in the UK (Partially sighted and unable to talk following a stroke 7 years ago) and is dependant on my wife for some of his care needs. She also has Power of attorney for his financial Affairs has he is unable to communicate verbally. He is not financially dependant on us however he is dependant on us for his care needs.

My question is what sort of documentation would we need to prove he is dependant on us and does he have to wait in the UK while I get residency or can he come out with us?

My wife is his natural carer obviously because it's her dad, She is not shown anywhere has his official carer so has no documentation to show. We do have lots of documents to show his health conditions though.

Thank you in advance

Colin

You should be able to obtain most of your answers via the following link including documention required to prove relationship to EU citizen:

I would contact Social Services for an assessment and you should be able to claim Carer's Allowance (an exportable benefit). I'm not sure if there would be any further allowances available but it would put everything on an official setting.
You could also contact the Overseas Team at DWP Newcastle, I have always found them to be very helpful.

Thank you Cheryl.

He does get DLA (Which I believe is not exportable) However will take up your sound advice regarding Social services and DWP

Please see the following link confirming the benefits that you may be entitled to when moving permanently to the EU/EEA. Just to clarify the point the previous poster made about Carers Allowance. Carers Allowance can only be paid if the person you are caring for is in receipt of Personal Independence Payment (PIP)/Disability Living Allowance (DLA) or Attendance Allowance. This is what is known as a qualifying condition. It is my understanding PIP and DLA are not exportable benefits unless the claimant resided in the EU/EEA before 31 December 2020.

You should check here, particularly the 5 year requirement which could be a plan breaker.
