I'm currently living in Alcoy and am looking at moving to Torrevieja. Once there I want to register on the Padron but I was a little confused as the Town Hall website seems to say an EU citizen will need to present their Residencia to register (as well as their passport, rental contract and NIE) I never needed to present this at Alcoy, just my rental contract and passport, and don't have my Residencia yet. Has anyone any recent experience of what documents were needed?? Many thanks everyone....

Hi,

I'm not sure if the requirements are the same at every town hall, you would assume so, but this is Spain so be prepared for the rules to be variable in how they are applied! We certainly weren't asked for Residencia.

Our experience at the town hall in Adsubia was good and they were super helpful.

You will need the following; official identification (Passport), your NIE number, a copy of a recent utility bill in your name and a copy of the deeds or rental contract for your property.

If you intend to buy a car don't forget to ask for a padron certificate as you will need this. Bear in mind that its only valid for a few months but they should be able to print off another copy whenever you need one.

Until not too long ago, councils didn't mind people illegally applying for padrons without being resident, as the number of people on the padron determines how much money a council gets from central government. That's why the law was changed to make is obligatory to have residencia before being eligible to register on the padron.

If someone changes municipalities, they should also do a baja from the padron where they're currently registered.

Unless the law's changed, you're legally obliged to seek residencia within three months of taking up residence here. People who don't take up residencia and enrol on the padron are not only breaking the law; they're depriving the council of income. And with Brexit in mind, until you've had residencia for five years, you could potentially lose the right to live in Spain.

Thank you for updating me. I certainly had no idea this was the case. My experience was posted in good faith.

When I enroled I specifically asked at the town hall and my Abogado about residencia and they both said not necessary.

I understand Brexit probably changes everything but as it stands now as an EU citizen my belief is that I have the right to live and work in Spain without becoming a resident.

As I'm not given to conducting myself illegally, could you be so kind as to post a reference to the law you are quoting on this site for my benefit and that of others please. And thank you again for helping me avoid breaking the law !

Real Decreto 240/2007

CAPÍTULO III

Estancia y residencia

Artículo 7. Residencia superior a tres meses de ciudadanos de un Estado miembro de la Unión Europea

1. Los ciudadanos de un Estado miembro de la Unión Europea o de otro Estado parte en el Acuerdo sobre el Espacio Económico Europeo tienen derecho a residir en territorio español por un período superior a tres meses. Los interesados estarán obligados a solicitar personalmente ante la Oficina de Extranjeros de la provincia donde pretendan permanecer o fijar su residencia o, en su defecto, ante la Comisaría de Policía correspondiente, su inscripción en el Registro Central de Extranjeros. Dicha solicitud deberá presentarse en el plazo de tres meses contados desde la fecha de entrada en España, siéndole expedido de forma inmediata un certificado de registro en el que constará el nombre, nacionalidad y domicilio de la persona registrada, su número de identidad de extranjero, y la fecha de registro.

Los ciudadanos de un Estado miembro de la Unión Europea o de otros Estados parte en el Acuerdo sobre el Espacio Económico Europeo y de Suiza tienen derecho de residencia en España por un periodo superior a tres meses si cumplen las condiciones previstas en el artículo 7 del Real Decreto 240/2007, de 16 de febrero, sobre entrada, libre circulación y residencia en España de ciudadanos de los Estados miembros de la Unión Europea y de otros Estados parte en el Acuerdo sobre el Espacio Económico Europeo.

CHAPTER III Stay and residence Article 7. Residency of more than three months of citizens of a Member State of the European Union 1. Citizens of a Member State of the European Union or of another State party to the Agreement on the European Economic Area have the right to reside in Spanish territory for a period exceeding three months. The interested parties will be required to apply personally to the Foreign Office of the province where they intend to stay or fix their residence or, failing this, to the corresponding police station, their registration in the Central Registry of Foreigners. Said application must be submitted within three months from the date of entry into Spain, being immediately issued a certificate of registration which will include the name, nationality and domicile of the registered person, his foreigner's identity number, And the date of registration. And: Order PRE / 1490/2012 Article 1. Right of residence for more than three months. Citizens of a Member State of the European Union or of other States party to the Agreement on the European Economic Area and of Switzerland have the right of residence in Spain for a period exceeding three months if they fulfill the conditions laid down in Article 7 of the Royal Decree Decree 240/2007 of 16 February on entry, free movement and residence in Spain of citizens of the Member States of the European Union and of other States party to the Agreement on the European Economic Area.

We got our NIE with a solicitors help it cost us 100€ each and 2 passport photos each. It was so easy, had it within 3 weeks here in Torrevieja,and we are not yet residences.
