Hi

Can anybody give me any guidance about this.We bought a house in august last year and want to apply for residency and we have our NIE numbers already. We were in the house and still are at the moment since november last year but have to go back next week as we have had our 90 days.

Do we definitely have to apply in the uk and as we were here and have NIE dies that gives us any rights.I keep hearing conflicting tales any advice would be appreciated.

As far as I'm aware the NIE doesn't give you any rights and your 90 days started on January 1st, not from November.

From what I've read when researching for a friend who is looking at buying here you will have to start the residency process from the UK.

Hi

In answer to your questions we are not on the pardon we do have a spanish bank account and have Bill's coming out of the account. We are not pensioners my husband is retired disabled but we do have to go back to uk as we dold our house and it is nearing completion so we need to empty it unfortunately

Yes, Trotter has given you good information. Under the Withdrawal Agreement if you can prove your were legally living in Spain before December 31st (and as EU citizens you were) then you can still apply for residency under the FoM EU criteria, which is much easier than the new requirements as third country nationals. there are a lot of advantages to apply under the old EU rules. But time is very short so call a gestor (or if you trust them, the legal firm you used for your purchase) who handles residency applications tomorrow and act quickly. You need to sign on the padron too. If you return to the UK at this point you wont get back into Spain for some time. Good luck.
