Need information

Hello my husband is a non resident.  He owns a property in Spain that has a mortgage. He rented the property out for a few years.  in 2019 he found a letter from the tax office. He gave it straight to his accountant.  He said he would deal with it.  We can't get any information out of the accountant, his Secretary mentioned that it had gone to high court last week, 3000e e has been taken from the bank acount since last November.  we had put extra money into the account to make sure we were covered.  we are facing financial difficulties.  my husband's job is affected because of covid.  It is now affecting his health.  We need to know why this is happening,  what we can do to solve the problem.  I think more money is going to go out.  Please can you help?   Is there an email address for the tax office, I would also like to have the address and phone number please.

Hi Margaret,

Was your husband's accountant aware that he rented out his property for a "few years"?  If so, I assume the accountant would have taken the necessary action to declare the rental income in your husband's tax returns?  If not, it sounds like the tax office has taken action against your husband to recoup the tax.  

The tax office also applies punitive penalties against people who evade tax and it may be this element to which your accountant's secretary refers.  Spain has been criticised by the EU for its tax office's disproportionate level of fines imposed for various transgressions, such as late submission of declarations, tax returns and tax evasion; in the case of tax evasion, the fine often being significantly greater than the amount of the unpaid tax itself.  This blog post explains more of the background:

Of course, if your husband's tax affairs are up to date, none of this is relevant.  Either way, I'm afraid it sounds to me that the only person who can answer your questions is your husband's accountant.  If your husband is too unwell to deal with this, is it possible for him to provide a written authorisation that allows you, or another trusted person, to deal with the accountant on his behalf?

I'm sorry to hear of the worry this is causing you both and I hope you can get the explanations you need soon.
