Change of ownership

My husband died recently and our car is in his name, how do I change it into my name and what would the cost be.

Have a look at the English version of the Spanish equivalent of the Highway Code on the N332 website.   It is run in conjunction with officers of the Guardia Civil and deals with anything to do with driving in Spain.   Alternatively, have a word with whoever is dealing with his Spanish will.

First of all you need a title of ownership on your name. Any notary public (you will need one) will help you to get it. Meanwhile you can use the vehicle.

You get it changed via a Gestor. We changed our second small car last year to Pre-empt  this situation as until all the will etc is resolved, I understand that you cannot drive his vehicle as it is part of his estate. It cost some 300 euros more or less.

I would double check with your abogado the exact legal position.

Hi Yvonne,

I´m sorry to hear of the loss of your husband, I hope you´re coping OK.

You need to speak to whoever is managing your husband´s estate, as the car will need to be included in the Inheritance Deed within 6 months of your husband´s passing.  When I helped a friend with this, the lawyer did not deal with cars, but recommended her to use Orke Services:

They´re based in Los Montesinos, so you may be able to find someone closer to you in Villamartin, but would probably still be worth calling them for a chat if your lawyer can´t handle it.  They were very good, so when my husband sold his car last year, we also used David (he´s Spanish and speaks excellent English) at Orke to handle the transfer to the new owner - from memory, it cost around €340, which was the transfer tax (based on the engine size, which was 2000cc) plus his fee.
