You have I fly back to the uk pick car my friend and her dog and drive back down and then drive her back after a few weeks holiday then I fly back to Spain do it twice a year.

Hi rds123,

If you're resident in Spain and you own the UK-registered car, you can't drive it in Spain.  You could import the car to Spain and transfer it onto Spanish plates, buy a Spanish plated car here, or transfer ownership of the UK plated vehicle to your friend.

That’s right transfer to my friend but have to insure it in Spain as no uk insurance company will allow me to drive it as I’m a Spanish resident.

Unless you are registered with DGT and waiting for an appointment to exchange a UK licence an exchange is no longer possible and you have to take a Spanish test.

Once you've acquired that then there is no legal bar on concurrently holding a UK licence although if it expires due to 10 year validity or reaching age 70 legally as a non UK resident you cannot renew it.

Hello,  Personally I think with the latest laws for UK expats you might find your in trouble. We are residence here in Benissa.

Tuesday 23rd I had to collect my late wifes belongings from the hospital including, hew campervan after she had died suddenly on the 17th November.  However on the way back I was stopped in Benitatxell and the camper confiscated.  Unknown to me they claimed that the vehicle was sorned and can never be driven again on the roads. They claimed the British offices has condemned the camper and you can never have it back. There is something very wrong with the police local at that town making that claim.

The facts are: the camp-er must be put on a vehicle transporter, taken back to the UK and off loaded to a driveway.  Following this you book an MOT, get a copy of the booking and then on the day you are free to drive to the MOT.  If the vehicle passes then that informs the DVLA who will then take the tax from your bank (if the arraignment has been authorized) and the camper is fit for the road.

How the hell can I get my late wife's property back to return it to the UK,

Hi Willlyn2021,

I'm sorry to hear of the sudden loss of your wife.

Have you checked whether you late wife's vehicle has a SORN (Statutory Off Road Notice)?  If you know the vehicle's registration number, you can check its status here:

https://www.gov.uk/check-vehicle-tax

It is illegal to drive, or even park, a SORN vehicle on a public road, so if the police can prove that, it would explain their actions.  However, if you can prove otherwise, via the DVLA website, this may help retrieve your late wife's campervan.

If you have a UK vehicle here in Spain that has no VED (road tax) or has s Sorn, you cannot drive it unless you tax it (easy to do online).

If your MOT has expired, it is not legal to drive on the roads in Spain (or France come to that) until it has an MOT. As you cannot get an ITV on a foreign registered vehicle, you will have to get it recovered to the UK on a breakdown truck/trailer.

All vehicles here have to be insured, even when it is off the road.

I have noticed a few UK vehicles that have been parked up in the same place on the road, with no MOT or tax. Surprised that they have not been removed by the police.

Condolences on the death of your wife. There is an article here from Ibiza which might help. You have an added problem in that you are not the registered owner and the vehicle is part of your late wife's estate. If you are already dealing with the probate of her estate you may have a legal representative to advise you. On the other hand it may be prudent to invoke the Spanish tradition of the undead and pay outstanding fines and retrieve the vehicle and have it transported to the UK and sort it from there.

I own a UK car in the UK and a Spanish car in Spain, I only have a Spanish license as I have Spanish residency, both are road legal and insured in their respective countries, I wasn't asked whether I'm resident in either country when I took out insurance, am I breaking the law?

As far as I have been advised: if you are resident in Spain then you are not allowed to drive ANY foreign plated vehicle in your name in Spain. It's just cost me €900 fines in Benitatxell to find this out.
