Buildings insurance on a complex

Hi everyone 

I’m currently in the process of purchasing an apartment on a complex in La Fuente.

The complex is next to a ravine and there has been a landslide/land slip there twice in the past causing damage to the communal area,a claim is currently ongoing and has been ongoing for the last 5 years.(still unresolved)

I’m still prepared to buy the apartment as long as I know that I’m insured if there was to be any further damage to the complex.

I have asked for a copy of the building insurance from the management company who run the complex but they have refused saying it is a data protection issue?so I’ve asked the owner of the apartment to get it for me and they have also been refused citing the same data protection reason.

Is there anyone on here who lives on a complex who has had difficulty getting hold of a building insurance certificate?

I wouldn't touch it with someone else's bargepole....... plenty of apartments out there without these highly expensive complications

The communal insurance is likely to be for the communal area only and probably won't cover your potential apartment. 

It might be worthwhile trying to get insurance on the proposed purchase. just make sure that you mention the ongoing problems. I agree with previous poster, unless they're paying you to take it off them.

The only trouble is the communal area includes the pool and sunbathing area and is only metres away from the ravine,if any further slippage was to occur there is a chance that this area could be at risk.

I would not buy myself trouble. As swimmer57 says plenty of other apartments without this sort of problem.

I think you may struggle to get insurance as there is already a known issue, or if you do get insurance it may be eye wateringly expensive again because there is a known problem & there maybe exclusions. We have had a number of minor earth quakes around here, (we live on Montegolf) not far from La Fuente that could affect the stability of the ground around the apartments.

    This is my fear at the moment that they will not reinsure where there has been issues in the past or that if they do have insurance then exclusions will apply to these areas of slippage,but I’m just guessing as they will not let me see the insurance policy - stating Data protection laws!

In that case I would ask yourself would you be happy to buy the apartment without these communal facilities, or pay a communal surcharge to repair all the damage should the insurance not pay out. For me it's a no brainer.

   Yes we really like the apartment and complex it suits all our needs,just trying to make sure insurance is up to date and covers the areas mentioned which have already sustained damage.

Just to add my opinion to the others advising against this purchase.

You have said yourself that the area is already damaged, why would you risk it ? 

As others have also said, please step back and consider the many other places available, who knows, you may find one that's suits you more ?

One thing that does cross my mind, is the property selling at big discount ? By the sounds of the area it would have to be.
