Hi I wonder if anyone can help we want to come over in January for 3 months to just stay and relax (not work). Do we néed a permit to do this and if we do can we never come over again in the November of the same year and stay again for 3months. Thanks for reading this message deb

You will probably need an entry visa. You can stay for up to 90 day in 180 day rolling period. So if you come over in January you should be ok for November too. Don't overdo the 90 days or it will cause over stay problems.

I know the trip you are planning is fast approaching but a lot depends on the outcome of the negotiations going on between the UK and the EU, deal or no deal will have implications for international travel and the likely hood for the possible Visa requirements and restrictions on the duration of your stay.

There is a lot of conjecture and speculation regarding the brexit process and what will be required at the end of the year.

Currently there are no formal restrictions on your travel. It is still in discussion what and if anything will be required, whether or not Spain will check, and or enforce is still purely a topic of discussion. 

If there are to be travel documents required I am sure you will have enough time to process these.

Hi Fozdeb,

Even in the worst case scenario of 'no deal', you will still be able to spend a maximum of 90 days in a rolling 180 days in the EU, without compromising Schengen rules or Spanish residency rules.  Although the UK Ambassador advised that new  immigration processes are in place and already being tested, he also said that no formal recording will start until 1 January 2021.  

Based on what you've said, you could come to Spain in January for 90 days and return to the UK for at least 90 days before returning to Spain in November.  However, you do need to be aware that any time spent in other Schengen travel zone countries will also eat into your 90 days in 180 allowance.  For example, if you were going to drive to Spain through France, your 90 days would start counting down when you arrive in France, not Spain.  There are online calculators available to help you keep track.

Not relevant to your specific query, but for travellers currently in Spain, I have just seen this update on the www.gov.uk website:

"The European Commission has not yet set out how the limit of 90 days in any 180-day period for visa-free travel will be implemented for those who are already travelling in the EU or Schengen Area on 31 December 2020."
