Hi everybody.

I was wondering if there is a land registry in this area as I want to register an interest in a property.

I am in a very difficult situation as I have recently found out that we had been lied to by our brother in law/brother. My husband and his brother inherited their parent's villa in La Fustera about 25 years ago. We were advised not to leave it empty so rented it out. As often happens, we were cheated out of a lot of money so contact was minimal. Four years later when my husband contacted him about the villa, my brother in law informed him that he had not realised the tenant had stopped paying in rent and had now claimed squatters rights and we had lost the villa. Since then we have had no contact.

My husband died recently in Greece and on my return to the UK found pictures on Facebook posted by BIL's partner of their lovely villa in La Fustera showing pictures of our villa. Admittedly they appear to have added a swimming pool and turned the undeveloped lower level into living accommodation and at the time I was in no mood to embark on what I knew would be an upsetting journey so let it go.

Two weeks ago my son was messaged on Facebook by a friend of BIL saying it was imperative my husband contacted his brother urgently to which of course my son replied he had died and what was it about and why was he rather than BIL contacting us. No reply. I messaged the man and said BIL should contact me personally and the answer said he would pass on the message and since then nothing. My son and I both feel it was a fishing exercise to confirm my husband's death. 

My Scottish lawyer tells me it would be a long and expensive legal battle involving UK and Spanish lawyers, something I am reluctant to embark but my son has said he does not want him to get away with what he has done and has offered £500 to at least throw a spanner in the works and make life difficult for BIL

In Greece, it was common practice to lodge a paper at the land registry for outstanding debts, liabilities, mortgages etc. so I was wondering if there is something similar in Spain. If so, the name of a local lawyer who could do this for me would be appreciated.

This is awful!


Rather than throw thousands at a solicitor, I suggest that your son spends the £500 on flights out to the villa and asks questions.  It probably won’t change anything, but at least you’ll get answers.


You can check who owns a property in Spain.  If I can find the link I’ll post it for you.

There is a Cadastral (equivalent Land Registry) office in Calpe, Ihave walked past it, but cannot remember exactly where. If you go to the Ayuntamiento, they will be able to tell you. To establish the  owner will require filling in paperwork and a small fee, when I did it, it was around 80 Eu. I also think it can be done online. Sorry just tried but can’t copy and paste. There is an English Language portal called something like Land Registry Spain, or you can try Cadastral España, both of which will return a multiplicity of results.

Thankyou. Took a while but eventually found the reference and have ordered a nota simple for £20 which will arrive tomorrow. It should be interesting to see what it says.

For anybody else who wants to access the Registry on line it is www.registro.es   if you don't know your cadastral reference - it will be on your rates bill from the Town Hall - then you just find your area in Spain on the map and zoom in to your property and your property number will be on it.
