Obtaining a GOLDEN VISA as an established property owner in Moraira

I have owned a villa in Moraira for over 40 years and visit regularly about 3/4 times a year This year I find myself running foul of the 90 day rule and it could happen in future years. Does anyone have experienced of over staying please and at what stage and where is any action taken - Eg will we be refused the return flight to the Uk when attempting to board ??

The reason for the likely overstay is due to an expensive pool rebuilding delay over which I had no control from the UK, hence the need for this visit to get it sorted on site.

Looking to future years I believe as a property owner you can get a "GOLDEN VISA " which enables to legally exceed the 90 day limit.

Does any one have experience of getting such an extended visa when your purchase was so long ago ?? I presume that if so it would have to be an application via my Fiscal Representative - solicitors , Clive Webster and co in Javea - is this so and how much should I expect to pay please ??

You get a golden visa if you purchase a property or properties in excess of 500,000 euro. There are other ways including bank shares or investing in Spanish businesses over 2m euro and 1m euro respectively.

But, yes, you can apply for a retrospective golden visa which means you can apply for a past investment even though you didn't so at the time of the investment if it was purchased from 28th September 2013 onwards. I assume that is the date when they were first introduced so you can't really apply for something that didn't exist at the time.

Always take professional advice, though. Quite a few legal companies offer this service.

Regarding overstaying, if caught by border control when exiting Spain they can stamp your passport accordingly and impose a fine and/or a ban on re-entry which I believe can be for up to 3 years.

Not sure if that would result in a denial of boarding in UK if attempting to fly back but it would result in a turning back on arrival.

'Engineering' a new passport wouldn't help as your biometric data will already be in the system and a routine scan of a new passport will reveal all.

It's a game you really don't want to play!
