I want to rent my property

Hi

I went to local town hall for information on renting my property.  A staff member gave me following information 

If you want to rent to tourists you will need a certificate and the area where this property is we are not giving any certificate at present. However if you rent it internally for people in Spain then u don't need a certificate and will need a management agent to help you to manage it.

Can you please help if this is true facts?

Hi mena,

Almost, although differentiating between foreign "tourists" versus native Spanish is not correct.  A Tourist Licence is required if you want to rent your property for short-term lets, e.g. a couple of weeks here, a couple of weeks there.  However, you do not need a Tourist Licence to rent your property on a long-term basis, typically a minimum of 51 weeks.  You cannot rent your property for short-term holiday lets to Spanish tourists without a Tourist Licence just because they're Spanish!

The Town Halls decide which areas in their municipality can apply for a Tourist Licence, because they issue the Certificate of Conformity required before the application process can commence.  Just because some properties on a particular urbanisation already have a licence, this is not an indication that other properties in the same area would also obtain one, if a Town Hall decides that a desirable ratio of permanent residents to holiday home lets has been exceeded.

Kimmy is correct. You can let your property for residential use without a License, but for holidays purposes you need the Tourist License regardless of the nationality of the guests. 

Licenses have been compulsory since 2015.  The requirement for the certificate from the Town Hall to be included in the License application was introduced in July 2018 and Algorfa stated that they would not be issuing them. That policy still stands so, I am sorry but you will be unable to obtain a license for holiday letting.
