Relocating with my family to Pego from the UK

Hi There

We are looking to move to Pego in September  - We have already secured a 6 month rental.

I am a EU citizen looking to relocate with my spouse and 2 daughters who are British citizens.We are not married or in a civil partnership. 

I would like some advice on the relocation process as researching online seems to get quite confusing and the information contradicts each other in some circumstances. 

Also if anyone knows of a good English speaking immagration lawyer in the Denia/Pego/Javea area that could assist us with reasonable rates.

My children will attend school in Spain and my partner will continue to work for his UK company as he works remotely. 

I do not currently have employment in spain therefore as the EU citizen would this effect our residency application?As my partner is the main income provider but he is a British citizen. 

Hoping to just get some advice on the above 😃

Confused. You say he's your "spouse", then you say you are not married?

You, as a EU citizen, can move to Spain and sign on the register of foreign EU citizens residing in Spain. This is the EU equivalent of residency.

If they are your daughters you can get them the same status. You would have to show you have private health care insurance for you. Under 18 year olds should get free healthcare. You also need to show an income of 600 euro a month and access to saving of around 7500 euro.

Your partner, on the other hand, would not be able to as you are neither married nor in a registered union. He would have to apply in his own right as a digital nomad visa holder and apply for that in UK. If your daughters are his children, he would have to show he can support them in Spain. 

We obviously don't know how long you have been together or how much you rely on each other but you can try and prove a bonding relationship which would be done with the help of a solicitor and supporting letters and so on to show you are a couple in all but name. Your partner could then join you on the EU register as your beneficiary.

Lots of hoops but good luck.

Maybe partner is the better word - Yes we have sufficient documentation to prove our relationship  - 24 years together and a 21 year old son(who will remain in the UK)Joint back accounts for many years/joint contracts /would that be sufficient?

Our two daughters will be relocating with us 😃 

I would prefer to get my partner onto my residency permit rather than a no mad visa - would that be a option then?

Just trying to make sure we understand the best route to take 😌

Yes you can name him as a family member of a citizen of the EU. A stable and unregistered couple can obtain residency in Spain if they can prove a bond is already there. It would seem the items you have would be sufficient for that and having children together would be an important part. However, things like bank accounts, joint wills, tenancy agreement and many other things can be used to show a bond has existed for a minimum period of 1 year.

The proof you have would be more than sufficient for that.

You apply for the Digital Nomad Visa in Spain at the local Ayuntamiento, not from the UK as Mark suggests.
